Hi everybody!
Can't find an official answer, so decided to ask here. I'm sure there must be lots of cases here like in my question.

On CIC website there are requirements listed, who can and who can't sponsor a spouse. One of the requirements is saying:

You can’t be a sponsor if you:
  • were sponsored by a spouse or partner and you became a permanent resident less than five years ago
What if a couple came to Canada under Skilled Worker class, where one of them was a principal applicant and another one was dependent, and then that couple got divorced. Can a person, who was a dependent applicant in that case, be a sponsor of another person, i.e. a sponsor of his/her new spouse? Or the rule "wait for 5 years" is applied here?

Thanks, really appreciate your answers.

Others can comment/correct me but once a PA and dependents have landed as PRs then the PA and each dependent are PRs in their own right.

A PA under a skilled worker class is not really sponsoring their dependents but including them as accompanying dependents. A sponsor in the immigration context would be someone who is already a PR sponsoring somebody, not a PA with accompanying dependents

As said this would be my interpretation so hopefully someone will comment/ correct me if wrong.

Bs65, thanks for your response! I have exactly same opinion and same doubts.

May be somebody else had such experience? I'm sure there should be some people here with the same case... Guys, please share your knowledge.

Your question has already been accurately answered by Bs65. No issues with sponsorship.

The rule only applies to those people who were sponsored via a spousal sponsorship to begin with. Since you arrived as a dependent on an economic immigration visa this does not apply.

With that being said, you might expect that your application will face some extra scrutiny if you recently landed and then divorced and remarried to sponsor someone else. You will want to have sufficient proofs to overcome the questions that scenario will raise.
