Extend his stay and apply as common law . As others have said he is a Brit he won't have any problems getting an extension. Apply outland , if for some odd reason he has to go home for an interview he will go to London, but honestly they are very few and far between .

Oh, also...
Where can get get Medical done and his Criminal report? He has no criminal background and is healthy but where does he get those from? :)

For his police report ACRO www.acpo.police.uk For the medical go to the Cic website and type in panel physician and locate a a Dr nearest to you and don't forget to tell them its an upfront medical .

I get the feeling that you haven't even looked at the sponsorship application package. Here it is: http://www.cic.gc.ca/english/information/applications/fc.asp.

There are guides and checklists that tell you very clearly what is needed, including things like how to get a medical and PCCs. Read through the ENTIRE application package; if you have specific questions, you can ask on here.

I've looked at TONS of stuff. It's just all so confusing. I thought we just applied for Common Law, or extended his stay. I've read a lot of stuff it's just always One person says one thing, others say other things and sometimes it's hard to find exactly what it is I'm looking for. I don't want to send in papers that are for something different or don't apply to us.

Start with the link that canuck_in_uk provided you with.

You will be sending in two applications (one for you, the sponsor and one for him, the applicant).

You will also need to send in all of your proof that you are in fact a real couple and have either lived together for at least 1 year (if applying as C-L), or marriage proof.
Your relationship proof will be things like:

Joint lease (or at least something from your landlord, if you're renting, showing that he's been living there with you).
Joint life insurance policies
Joint cell phone bill
Joint bills

...the theme is `joint', since you have to prove that you're not only a genuine couple, but that you've been living together.

Photos, text messages, emails, fb crap, letters from family and friends verifying your relationship, etc.


ALL of this (2 applications + your mountain of evidence) gets put into a larger envelope. box, or whatever, and is sent to CIC. They will then tear it apart and once you are approved as his sponsor, will begin working on his application.

Sorry for sounding annoying or confusing. I just wanted to get all my information straight that's all.

What I still don't know though (I know i'm sounding like a broken record) is if we apply for all this and it gets sent off Outland, can he stay here with me until he hears back? He isn't looking for work or going back to school right now as he just Graduated Uni in England. So would it be like inland and he have to apply for a Work or Study visa? He was hoping to get his PR then look for work as work where I am is hard enough as it is.

Submitting an outland app doesn't give him any form of status, nor does it qualify him for a work or study permit. He will need to continue to extend his stay as a visitor.

The links you posted are for inland. The link I posted is for outland. Make sure that you are using the right application package.

No, his PR application will carry on, regardless. (He may have to leave Canada for a while and then come back.)

But really, being denied an extension is very very uncommon for visa-exempt people with a PR application going on. I have heard of people asking for 2 years and getting 1. But I haven't really heard of people getting outright denied.

I agree with Kayaker. As long as you can show sufficient proof of funds to support the extended stay, there should be no issues. Request a year, as that should cover the PR processing time so that he doesn't have to submit another extension.
