Can a Visitor in United Kingdom Apply for a visit visa for Canada.

Hi,

My mother-in-law(Pakistani passport holder) is on visit visa in United Kingdom to visit her daughter and Son. Can she apply for Visit visa to Canada from United Kingdom. She also has a Bank account in UK and manages a business in Pakistan. ( Has all the required documents of business and banks)

Yes - she can apply from the UK. Note that it may take several months for her application to be processed.

The processing times from London office says that it will take 11 days for processing. So why should we anticipate that it will take several months for processing ? .

Don't rely on the processing times posted online. She's a visitor to the UK and can expect longer processing times. I would assume 1-2 months to be safe.

5. What level of funds is in the UK account? Does she have accounts in Pakistan? Any assets in Pakistan? Any say pension income?

6. Who is looking after the business in her absence? CIC are more wary of self employment/ business TRV applicants since you don't have to be physically present for the business to operate. You can always have someone else run it while you hang out potentially long term in Canada and/or even sell it. If you are employed then you have a short term period of leave/vacation and have to go back to work or else you lose your job which is a pretty good incentive to go home!

Most visa posts either don't allow short term visitors to the country they serve apply for visas or they refer your application back to their visa post in your home country. This because the home country visa post has a better knowledge of the socio-economic situation back home and can better vouch for proffered documentary evidence. E.g. the visa post in say Karachi will quickly know if a TRV applicant's stated place of business/employment is actually a street address that doesn't exit or submitted bank accounts are fraudulent/from a bank that has ceased trading etc whereas the visa post in London may have no idea.

- In UK might have around 8000 GBP(16000 CAD) in Bank.
- Yes, have account in PK and have good considerable amount
- Yes, have assets in PK
- Yes, receives pension too.

1. She has a valid enough visit reason - she needs to provide proof of relationship so birth certificate of her daughter as well as proof of her daughter's status in Canada (presumably PR/Citizen?)

2. Good that its a year..some visa posts see someone almost at the end of their say UK visit now seeking a Canadian visa - it can come across as someone who doesn't want to go back home.

3. Ok..its proof of visa compliance.

4. Indicates less of a risk factor to the UK immigration authorities so possibly/ may translate over to Canada Visa Officer (VO).

5. Well she has to provide historic bank statements to prove their isn't a recent deposit of significant sums. London visa post may actually be ok with Pakistan financial documents since it also processes Economic and Family Stream PR applications or Pakistan so the VOs know what to look for. She should also provide official documentary proof of the assets and the pension. Often its recommended asset certification/attestation be done by an accountant. Visa post will evaluate level of funds against proposed length of stay. Usual recommendation is to indicate a short term visit say 3 weeks max ...those TRV applicants stating they want to be in Canada for multiple months are the ones who have issues.

6. She has to show ownership and financials for this business including a management structure. I think this is the area where visa officer will scrutinise - e.g. seems she can 'overstay' stay in Canada for say one year without any impact on the business. Does she have any proof of her need/requirement to go back to operate this college?

7. As a side issue visa post may enquire as to if there are any young kids/ new born in the picture - they are aware of the child care aspect of these visits and consider it work.

On paper it looks like she has a good chance and I don't think it will take significantly longer than the stated processing timelines but it comes down to the proof.
