Hello Guys,

I have applied for the spouse dependant PR on April 2019 from India and my husband reside in Canada as an PR.Its been 6 months since we got married and its been really a tough time being apart. As the process is time consuming.
a)Is it possible to apply with an AOR for the TRV(Temporary Resident Visa) ?
b)How far would be the success rate for the TRV if applied?

Can anyone share an insight on that please.

Thanks in advance.

A) yes
B) depends on luck but generally rare. I recently applied but we were denied because they thought my wife wouldn't leave Canada due to the purpose of her trip (my birthday and a 2 week vacation).

Given that a TRV is neutral on PR, I would say to apply. When I have some time I'll let you know what we had in my application.

Spouses will generally be denied TRVs because there is too much of an opportunity for them to remain in Canada, especially with a PR application ongoing. TRVs are not intended to be vehicles through which to "wait out" a PR - the spouse in that case is not a genuine visitor.

Assess your own situation and see if you can show extremely strong ties to your home country where the officer feels this person would definitely have to return to their own country. If you find such strong ties, go forth with the application. The chance of refusal is still high but it can also work in your favour.

These ties will be things that are obligations that the person cannot do from Canada; such as caring for a parent in a hospital, etc. Large concrete obligations you cannot leave.
