Can a Manitoba PNP PR move and settle in another province?

Hello,

I am MPNP PR and I am planning to move. I have been in Winnipeg for a year and not able to find a job. so planning to move to ontario for jobs. From other discussions it looks like moving won't be a problem but still got stuck in some confusions.


However, 3 questions regarding the change of province?

1. How long one have to stay in Manitoba if he/she landed as Permanent Resident in PNP program in Manitoba, before they can move to another province?

2.Does after moving to another province, the days he/she spends in new province will also counts for PR card renewal?

3.Does it have any effect or delays in Spousal Application, which they have already applied from Manitoba province before moving?


Please give your feedback, i will really appreciate.

1. There is no minimum time that you have to stay. You signed an intent to settle when you applied and by staying for a year, you have really given it a try. They can't really ask for more.

2. Yes, it's PR of Canada, not of Manitoba so days spent in Canada will count towards your residency obligation.

3. No, it shouldn't do anything to complicate your spousal sponsorship as long as you don't more to Quebec.

You are free to leave Manitoba and settle in another province. However, your sponsor will not be able to sponsor other relatives in the future.

This is an old thread but I will answer anyway. Yes I know of at least 5 people whose PR was successfully revoked due to moving to another province.

but I am wondering how did they find that info, that person moves to diff. province
Basically, I have sponsored someone in MB and then they move within a month to different province now I am wondering what should I do, should I inform to PNP office just to be safe myself or should I quite,

I highly doubt that..because:

  • 6. (1) Every citizen of Canada has the right to enter, remain in and leave Canada.

  • Marginal note:Rights to move and gain livelihood
    (2) Every citizen of Canada and every person who has the status of a permanent resident of Canada has the right
    • (a) to move to and take up residence in any province; and

    • (b) to pursue the gaining of a livelihood in any province.

To be clear:

Unless there is a specific, formal condition (which to my understanding, the sponsored PR does NOT have), a sponsored PR cannot have his or PR status revoked except for inadmissibility. Moving to another province CANNOT be grounds to revoke the PR's status.

PR status can be revoked for fraud in obtaining the status. To some extent a PR's conduct after landing can be relevant evidence if fraud is suspected. It is more likely, however, that a sponsored PR's move (relocation to a different province) is a factor, in CONJUNCTION with other factors, that TRIGGERED a fraud inquiry . . . but the actual ground for revoking PR status is fraud.

Thus, it may appear that a provincial sponsored PR lost PR status due to moving to another province, but IRCC needed to show actual misrepresentation in the application for PR process in order to revoke status. (Reminder: any material misrepresentation in the process can be grounds; does not have to be a misrepresentation by the PR himself or herself; thus, for example, misrepresentations made by the sponsor, or by employers, can be the basis for finding fraud and revoking PR status.)

While the reporting is sporadic, there have been some indications that like other aspects of the law respecting PRs, in recent years there has been a trend to more aggressively interdict and more strictly prosecute perceived violations, including fraud in the provincial sponsorship programs.

I recall one citizenship applicant that got hit with an RQ, with the focus being that he got his PR via Manitoba PNP but his past address history does not list ever having a Manitoba address. He admitted that he stayed in Manitoba for a few days before moving to Ontario, where he has been ever since. He thought landing in Manitoba for a few days would be "enough". Not sure what ever happened to his application. But this aligns to dpenabill's comment that misrepresentation/fraud is usually the root issue.

Wpgkam - you are missing main point regarding misrepresentation. A PR can move about the country - that is true. The issue is if the PR can be found guilty of getting PR in the first place via misrepresentation (never intending to settle in Manitoba). That is the real issue. If they misrepresented themselves when applying under PNP, then that can be a problem.

Ok do you know what was the main reason for those people whose PR card rewoke
They were proven to never having INTENDED to reside in Manitoba. Most moved out of Manitoba in under 3 months, one in 6 months. I am not at liberty to discuss details further.
