can a foreign worker apply for a common law

hi!
I just wanna know if we foreign workers are allowed to apply for common law?
My partner is outside canada, we're thinking to apply for a common law so that
she could go here. I've done my 'homework' about the it. we used to live together
for a year before i got here in canada and we have a joint account back home.
My work permit status is low-skilled (food-attendant) worker, but im working with my employer to have that
change to skilled (cook) worker upon renewal of my papers.
Just in case, my papers have change can i do this common law?
What are the specific forms I or We need to fill up? what other supporting
documents that they need?

You have to fill out a declaration of common law union. Once you have your work permit as a cook, she can apply for a TRV based on your work permit. She could be denied though. It is not enough to prove the common law union. She also must prove that she has strong ties to her homeland and will not overstay in Canada.

the declaration for common law union? how is that? im here in canada, do we have to sign that together or should o fill up that form and then send it to her?

You can find the form here: http://www.cic.gc.ca/english/pdf/kits/forms/IMM5409E.pdf but there is no point in doing that before you have your skilled work permit and she can go apply for her TRV. She will not get a TRV based on your low skilled permit.

I didnt declare her when i first got my work permit,because i didnt know that there's a law like that here in canada.
I'll wait for my papers to come out as a skilled before doing so, but i just confused about the declaration of common law union,
on the bottom part there's a Declare before me at (City, Town, Village) Commissioner of Oaths (Name), etc..
so this means that we have to go a commissioner or judge and do the oath of the declaration of common law union? do
i have to go back home and do this together infront of the commissioner? or can i just sign the form and send it to her?

Not having mentioned her when you applied for your work permit can be a problem as they might think you are making this up now to get her a visa. However, if they don't believe you, you have the option of getting married. Still does not guarantee that she will get a visa though.

just a quick question guys, how can i change my marital status or declare my common law partner on my papers before processing my renewal for my papers?
is this possible? im a foreign worker,honestly the first time I fill up a my Work permit, i didnt say common law partner, because back in our country there are no common law. that's why i put single when i fill up the form. is there a way i change that and declare my partner as a common law?
