Sounds complicated but, Can a Canadian Citizen by birth marry someone that is living illegaly in the USA. Marry in the USA. Long story short. Is not a scam we havr a 3 year old together, I lived legally we this person for 2 years, but have to leave Canada, I decided to go to the USA to get money faster for applications and lawyer since it is easier than in my own country(mexico) so I enter the US illegally, lucky me didnt got cought crossing,
So we are gonna start applications, but we never got married, so my question is can I marry her here or do we have to go to mexico? I dont care if I get banned from the us as long as it doesnt afect me in Canada.
Thanks in advance

So long as you both have all the documents that you need in order to obtain a marriage license, I don't see a problem with that. But I'm not from the U.S., and the requirements likely will vary by state.

I would encourage you to mention it.

But it may cause suspicion. What you're going to do is immigrate somewhere, with a past of immigrating illegally.

So just be ready for questions, but honesty is the way better path.

Hopefully someone with more detailed knowledge can guide you here.

You can get married in the US however your PR application will have to be processed through the Mexico visa office. If an interview is required it will also be held in Mexico and this is where your passport will have to be sent when it's time for visa stamping.
