I am new on this thread, I saw lot of people here who have applied to from US. I have question but its not exactly related to topic.
I am in dilemma first let me explain my situation. I am Indian Citizen but now in United States on Student Visa. My Visa expires in Dec, 2012.
I have applied under AINP ( Family Stream). I have submitted my Fed application in May, 2012 without FBI Clearance. I had received FBI clearance in June, 2012. I had DUI ( Driving under Influence) but it was dismissed that why Background Check got delayed. I haven't sent FBI clearance yet, I had called CIC twice for sending FBI clearance. They said it's upto u but the will ask when they will open my file. Right now my application is in CPP- Ottawa since June or July, 2012 and my VO will be in United States (Detroit).
Now question is that when I will go to India after Visa expires should I tell them that I am going to India, by doing this New Delhi( India) will be my VO.
I would have been in processing for 7 months here but new VO, New Delhi will start everything from scratch. It might take another 7-8 months or more.
I m screwed:(. What should I do?

first to make it clear...your vo will never be changed to New Delhi if you move your residence to india. if CIC follows that approach then its gonna take for ever to transfer your files alone. CIC will stil process your file in CPP ottawa and issue notification to get your visa stamped in Detroit/NY etc. At this point of time your only ting to do is send the fbi clearance without delyaing. If you get to read cic note on this police certificate after 6months are not valid. send it let them add it on your file first. let the processing go on...also once you go back to india update your residence address to CIC without fail. once processing is completed when your PPR comes thats when you need to find some way to travcel back to US to get your visa stamped in the embassy or you can query CIC to check if you can send your Passport to NDVO for a single entry visa to canada and you come here to get your copr and landing process to be completed. there are ways to work out. But i can be 99% sure your vo will never be changed to NDVO.after applying we are forced to move to different countries due to job,personal,etc our file cant keep following to that specific visa offices for that country... NDVO does everything in a different way. so rather than assuming it ourselves send your fbi clearance first to CIC.


btw as xse pointed there are lot of other ways to stay back in the US itself. so get your options clear...but whatever you do moving out or changing status do let CIC know it immediately.

Why do you want to go back to India now?...Have you tried the OPT stuff after your US-F1 expiration? Did you finish your schooling? And why haven't you sent down the FBI certificate since you got it?..Please take time to think of what you really want before you move so that your whole life dont get stuck in Canada Immigration

No I can't get OPT......my visa expires in Dec....I got FBI Clearance in July, 2012...dere was some error on report so it took time....now when I called CIC they said its upto you, but they said they will ask for it when they will open your file....I think I should send it now....

thanks for the reply......I have visitor Visa ( multiple Entry) for Canada....My question is that when they request Passport it's possible can I just mail my passport to Detroit?
and then go to Canada from India for Landing....and when I change my address to Indian address you think they will still ask me to submit passport in US?...

as per indian rule we are not allowed to send passport outside country (to or from india) so that ruled out. if your file is not started at all..i mean no checks had been initiated they can send your file to ndvo otherwise i dont see them sending your file to ndvo...but when process is complete you can ask cic explaining your situation and ask them how to submit..they might ask you to send to ndvo internally they might issue visa..but consider delays in tis case...

Yes, I know by mail you can't send it....but if some family person or friend take my passport to US, my friend did this.....I am concerned more about time, if they send my file to NDVO I will have to wait for another 7-8 months:(
 
I got my PPR today.

you can very much ask your friend to get visa stamped on ur behalf from usa...no issues in that... but i dont think so you should be worried on the timelines...if it was moved to ndvo for visa issuance purpose alone it wont take 7-8months..
