Hi Folks

I have been speaking to an employer in BC and they have offered me a job as a senior recruiter with one of the restaurants they own. They currently employ around 120 people and I will be responsible for managing end to end recruitment for all the roles .

I do have 5 years plus experience as a recruiter. Can I please confirm if the BC nominee application will be approved easily ? Or is there any thing I could do to ensure that the application doesnt get rejected.

This is exteremly important for me and all your valuable thoughts would be highly appreciated

Cheers

Hi, did you already have an open work permit, or did they review your job application without one?

Hi

under which NOC code this profession is listed? Eligibility depends on that.

If you're in Canada already - that's another case.

if your perspective employer will be able to prove they spent some time in searching within Canada - you'll definitely get the nomination.

So - good luck! (And hire me one day :) )

Hi Movado,

Will my employer need to apply for LMO first ? Is that mandatory ?

Many Thanks
If you want to work before BC PNP will nominate you - yes, you need to get LMO first. But if you got the nomination - it's sufficient to apply for work visa and work in Canada during the rest of the process.

Thanks Again Movado.. Apologies If I am asking the same question again but its very confusing. My employer made the same enquiry from BC PNP was not given a clear answer whether he needs to apply for LMO or not but was sent this information (in Bold ):

http://www.cic.gc.ca/english/work/employers/lmo-basics.asp

As an employer, you may need to apply for a Labour Market Opinion (LMO) before you can hire a foreign worker or get pre-approval to hire a large number of workers.
A positive Labour Market Opinion will show that there is a need for the foreign worker to fill the job you offer and that there is no Canadian worker available to do the job.
You can find more information about LMOs and application forms on the Temporary Foreign Worker Program website.

Not really sure what this means - I am currently in Sydney, Australia and I dont intend to move until I get my permanent residency. Can i please confirm that my employer will not need to apply for LMO and can directly apply for the nomination for British Columbia ?

Could you please also suggest if he should deal with a lawyer ? If yes, Could you please recommend one ? Did you also go through the BC PNP ?

Many Thanks

No need to involve a lawyer at any stage.

It's sufficient to have a job offer from BC employer for a high-skilled job to apply for BC PNP. If BC PNP nomination granted - it allows you to apply for a work visa without LMO. LMO is required if you intend to work before the nomination granted. If you don't want to move without PR (as I am) - LMO is obviously not needed as you'll become a PR-holder at the airport. But your perspective employer will have to wait for around 1 year to get you in PR status.
Everything is brief and clear here (official BC PNP web site) - http://www.welcomebc.ca/Immigrate/immigrate-BC/Provincial-Nominee-Program-Home/Strategic-Occupations-Home/Skilled-Workers-Who-Can-Apply.aspx#occupation

Thanks Mate. you have been very helpful and you are exactly the kind of person I was chasing :)

Not sure, If i am asking for a lot but my employer runs two restaurants. The NOC is 1223. Whats the liklihood of it getting approved ?

If you dont mind sharing, Could I have the access to the cover letter and employment contract and any other documentation that you employer submitted for you ? Happy for you to cut copy the body and hide the personal details .

I will be very appreciative of this. In case it is okay, please email me at robbie.fernando @ rocketmail.com

best Wishes
Rob

Getting the nomination is not based on your NOC code. No one can tell you if you are going to get nominated just based on NOC 1223.

And I find it a bit ridiculous to ask for other people's PNP documentation especially when the documents are confidential. Maybe you should ask your employer for the documentation you need for BCPNP instead of fellow forum-mates since they are the one who's going to hire you.

I would suggest you should go through the website again

http://www.welcomebc.ca/pnp

You find everything stated in the checklist. just follow it. If the pnp people have questions, they will contact your employer for more information.

If you are applying outside canada and wait for your nomination there, you do not need a LMO.

Is there any Province that not required any job offer to get in ??
