1. You are a June 2014 CEC applicant. What date in June did you apply? I can't believe you still have not gotten GCMS eligibility set to passed yet. Can you apply for your GCMS notes now and see what is the status on it?

2. Go back to the IMM5710 form that you submitted. Can you double check you have filled it up correctly? Did you choose Open Work Permit for first question page 3? I am suspicious here because their letter said "you are not eligible to apply document of this type". What is THIS TYPE? They have not even given the specifics correctly?

Did you manage to get a hold of any CIC agents today to discuss this? I would strongly suggest you get a lawyer for your next actions.

I applied for my BOWP last Saturday and looking at the rejections, i am thinking to withdraw my WP application for now (as i applied 117 days before the expiry of my current WP).

And now, I cannot access MyCIC account for last two days :mad: :mad:

It seems like dealing with some re***ded system. GCMS should be live, so we can act and manage our lives accordingly.

Anyways, just wanted to confirm that others are also getting "system maintenance" message for mycic account.

Also, does anyone know the procedure to withdraw an online WP application ? Do they refund the fees ?

There is nothing wrong. But since people are getting rejections, I am not sure if this is due to new rules that came out on Dec 01, 2015. If that is the case, I will withdraw my application for now and apply about a week before the expiry of my current WP. This will buy me more time on implied status and hopefully eligibility gets passed by then or if they start working, I might get my PR ;D

Also, in the link below, CIC clearly states that if the completeness check has not been performed, your BOWP application will be held (put on hold). However, if your PR application that you submitted is found incomplete, only then will your BOWP application be rejected.
If anything that I have mentioned above does not apply to his application, then there is extremely high chance that the Visa officer made a mistake.

My only question was why was I issued BOWP first time and rejected second time when the PR is still in progress?
if the rule has changed it should be for new and initial BOWPs only.

Did you check with call center, since your GCMS is still on way ? Call them and see if you can find any other info.

This is smart! I have applied in Oct for a BOWP as well.
I will monotor this page to see if they are rejecting more people. If yes, I will withdraw as well and apply before expiery of my WP.

Well it does say on the CIC website that extension on BOWP will be on a case to case basis. They haven't mentioned anything else. There are a couple of possibilities:

1) They have found an issue with your eligibility and may be rejecting your application entirely ( or reach out to you for explanation etc.)

2) They contacted you for more information but you didn't get it or you did not reply

3) They have already issued PPR/COPR to you but due to typical CIC errors ( email typos, server issues, missing mail) you have not received your PPR/COPR.

4) Visa officer made an error in reading your GCMS notes.

I still believe that AOR should be sufficient for BOWP approval because if you look closely, AOR says the following:

"Upon review of the information you have provided, your application is considered complete based upon the requirements of the Instructions and Regulation 10 of the Immigration and Refugee Protection Act (IRPA)"

What supports my belief is the fact that a couple of applicants who sent their PR applications in Sep/Oct 2014 and applied for BOWP around the same time as you (august 2015) have been approved. There is no way their status would be set to passed before yours unless your file is in second review.

So unless they have discovered something on your file that they are not happy with, after they sent you an AOR, only a visa officer error seems plausible in this situation.

Hi all,

I think it is a good read. As long a you are working under NOC 0 or NOC A positions or received positive eligibility after your PR application such as AOR for CEC applicants, you are exempt from this rule. So you can continue working even though your four year limit is passed.

For those who want to work temporarily in Canada, there is a 4 year maximum (cumulative duration) rule. This means you can only work in Canada for a total period of 4 years.

When you reach that 4 year limit, you have to wait another 4 years before you can work in Canada again.

No big deal right? Well, it depends.

The problem is that lots of work activity in Canada counts towards that 4 year period, and you might be surprised what it includes.

The following list of activities in Canada count towards your 4 year limit. So you have to include all those days spent in Canada and begin adding them up:

Time spent working with a work permit (obviously).
Time spent working under a post-graduation work permit.
Time spent working in Canada under an exemption to a requirement for a work permit. Here’s where people sometimes stop counting, but it’s all included. So for example, if you are here as a business visitor without a work permit, each day still counts towards your 4 year limit.
Time spent in unpaid work. Whoa – most people miss this entirely. Yes, if you are working here as a volunteer, this time still counts towards the 4 year limit!
So what can you do in Canada that won’t count toward the 4 year maximum?

The following type of work will not be counted toward to cumulative duration of 4 years:

Time spent working before April 1, 2011; and
Time spent working while authorized to study on a full-time basis, such as co-ops and internships.
There are also some exceptions from counting toward the 4 year maximum. These are as follows:

Gaps in employment in Canada of one month or more (for example, traveling outside of Canada, periods of medical leave and so forth. BUT vacation time and part-time work don’t count here. So you can not take a one month vacation and subtract it from your 4 year maximum.
Time spent working in managerial or professional positions (NOC level O or A) are exempt, however, the time spent working is still counted. For example, if you were working as a professional for 4 years, then you wanted to work in a different occupation in NOC B, you would not be issued a work permit. You could continue to work as a professional however beyond the 4 year period.
Time spent working in a labour market opinion exempt category such as NAFTA, or spouses of workers with a work permit, or those with in-Canada permanent resident applications under way.
Those who have applied for permanent residence and received a Provincial Nominee Program certificate, or who have received a positive selection decision under the Federal Skilled Worker Class or Canadian Experience Class.
Remember, it is up to you to convince the visa officer that your 4 year cumulative period has not elapsed. So keep records of what you were doing and when, especially if you plan to rely on one of the exceptions above.

Let’s say you’ve worked in Canada of a total of 4 years when you add-up all the days since April 1, 2011 (when the rule started).

What can you do?

You can either continue working in a category that is an exception (above) or wait for 4 more years NOT working in Canada, in order to work in Canada again.

Why is this rule in place?

CIC is simply recognizing that the temporary worker program is temporary. It is not meant to go on indefinitely. CIC is trying to encourage people who work in Canada for lengthy periods to apply for permanent residence.

Hi,

I filed my BOWP application through my lawyer online on Sep 10, 2015.
I am not sure whether the date they have on the CIC portal in correct, because it says application being processed as of August 1st, but in the forum people is see people getting BOWP for August 31st.

Could someone please clarify?
