Good news kunishsa. Even under OB485A, it still seems possible to get around the four-month rule if your case has merit.

I'm half-expecting an OB485 "B" to arrive shortly...

Hi All

I just got my WP approval. I am so happy to see it. Literally I can not explain how much happy I am. Even my wife started dancing looking at the document :)

Even then the suspense in my life still remains a little bit, looking at the message I have on myCIC. It says Permit - WP-EXT / Permis - PT-PROR. I am not sure if it is BOWP or a closed permit, though I am positive because I had applied for BOWP.

Following is the message I have in my CIC.

Dear

Your application to remain in Canada as a temporary resident has been approved. A secure document has been mailed to you at the address that you provided when you made your application. If you have not received your secure document within six weeks, contact CIC.

Type: Permit - WP-EXT / Permis - PT-PROR
Validity: <date>

This letter is not valid for travel and is not a permit allowing you to remain in Canada.

Sincerely,
Citizenship and Immigration Canada

Thanks & regards,

T_T I applied my BOWP last Monday, 18th, November... Hasn't received any comment, and gave a call to CIC. The representative said that they haven't open the files who submit application on 18th yet... They are still working on Nov 7th... Is it true?

Ok, I just called the CIC again, and the auto reply said yes, my application was approved. Does it mean that I got the work permit?
Thank you~~
Your application was approved? That's good news.
Mine will be late today or tomorrow I hope.
The auto reply says they received my application on Nov, 19.

Thanks a lot LPS. Even I am guessing the bridging work permit concept might be ended from 1st Jan, 2014.

Why would they discontinue the BOWP? Doesn't make sense at all. I agree with LPS, I'm also expecting
an updated operational bulletin for BOWP applications fairly soon.

Yeah they'll keep the BOWP going, but maybe tweak the criteria a little to address more complicated cases. I don't see them making any official exceptions to the four-month rule - for example, for closed permit holders who are made redundant and get a new job offer. I still think a so-called "job offer" is not worth the paper it's written on if it's not accompanied by an LMO and it relies completely on a lenient interpretation of OB485A.

It looks like they are only approving those with new job offers if current WP is valid for over 4 months, which suck for people who lose their current job...

Agreed about the offer letter. Along with it If the person is staying in Canada with his family for sometime, there is a fair chance for getting the BOWP approved with a detailed explanation letter. I have highlighted about my family here in Canada as the primary concern which is actually true for any family guy with wife working and/or kids going to school.

So if a family person files with a proper explanation letter stating the concerns in detail would give a benifit of doubt even with out an offer letter.

Cheers,
Kunishsa

This is what's on OB485:

-------------------------------------------------------
Issue

Foreign nationals, in Canada, who have been approved under one of these Economic Class programs and whose temporary resident WPs are due to expire, require facilitation that enables them to maintain their status and allows them to continue working in Canada while they await final decisions on their PR applications. Furthermore, efficiencies are gained by avoiding unnecessary requests to Human Resources and Skills Development Canada (HRSDC) for subsequent labour market opinions (LMOs).

-------------------------------------------------------

LMO's are getting harder to get, especially for employers who don't know how to do it. I think the bold part is the spirit of the rule, so what if someone lose their job with WP > 4 months? I think they should just remove the "and whose temporary resident WPs are due to expire" part....

You are probably right about the spirit of the rule. It looks like they give applicants a break if there are extenuating circumstances.

On the other hand, if employers are routinely offering these long, one or two year contracts to foreign workers without the intention of honouring the full term of the contract, it's not a situation that ought to be encouraged.

Hi,

On IMM5710 when applying for open work permit, what selection should i check: A work permit with new employer OR Restoration of temporary resident status as a worker OR both.

Thanks in advance.

Most people here select 'New'.
