Hi All,

I got married recently and trying to apply for an outland spousal sponsorship from india. Could you let us know if showing a birth certificate is mandatory?

Problem here is hospital i was born doesnt exist for a decade now and doctor is also no more. And when i applied to local muncipal office for birth certificate they have rejected the application saying records doesnt exist.

I have an identity card, passsport and my metriculation 10th certificate. I was born before 1990 and in india metriculation certificate is considered as birth certificate for people born before 1990.

Can i show 10th certificate and write an explanation letter explaining my condition..or is there any other way for showing birth proof?

Any help would be of great help and much appreciated and if i am posting in wrong place please redirect me to the correct link.

Birth certificate is mandatory to prove alot of the essential information about u, like your name at birth, age, place of birth, mother and father name, they must be some form of document u can get from the hospital to prove the birth taken place there.

I could be wrong but I believe it's mandatory for the application.

I believe this will help answer your question. Establishing identity and relationship
As a foreign national you must be in possession of one of the travel documents identified and accepted by CIC in order to become a permanent resident.
You may establish your relationship to the sponsor by providing a birth certificate, a baptismal record or a marriage certificate. Dependents may provide similar documents to establish their relationship to the principal applicant and/or the sponsor.

In the absence or unreliability of such documents, other types of official records may be acceptable, including but not limited to:
  • voter's registration lists
  • military records
  • expired passports
  • income tax forms
  • school records
  • household registries
  • hospital records
  • old immigration records
  • notarized letters from reliable bank officers, religious leaders, police authorities or civic and other government officials
Haven't said this. I believe you have many option. Either to get any of the above or go for the last option on the list. i.e notarized letters. Hope this help.

Do you have proof (like a rejection letter) that municipal offices were not able to find your records?

The application guide says that if you don't have a document then you have to have a detailed letter explaining why you don't have it. So while I can't tell you if it will be sufficient, the least you can do is include the documents that you have (like your matriculation certificate, and anything from the list babsizkill posted above) and be VERY detailed in your explanation letter. Include a rejection letter from the municipal office if you have it (if not, at least explain that you have applied for a replacement x number of times and have been denied), that demonstrates that you have attempted to get a birth certificate. An explanation letter should be enough to keep your application from being returned for a missing document, and from there IRCC will let you know if they need more information/documents for processing purposes

You asked this in a different thread to which I replied. Check the country-specific requirements for India, and best to also ask in India specific threads (e.g. NDVO). It appears that other documents may be acceptable in some circumstances (or put differently, other documents accepted there in lieu of birth certificates).

At any rate add a letter of explanation.

I was missing a death certificate and my husband was denied because of it. We did not recieve a procedural fairness letter or request fir it at any time, AND i wrote a detailed letter of why i did not have it. We are now stuck in appeals.
