Birth Certificate Translation- Please help

Hi,
I have birth certificate, which was in my native language and translated to English at back home.
The English translated Birth Certificate has following details

1) Certified that this translation from XXX language to English is correct
2) Put his stamp and signed it ( Stamp shows – Government authorised Translator, Register number)
However, the Translated Birth Certificate is not notarized at back home

Will this Birth Certificate be ok to submit along with original document certified copy??



Below are the details from CIC website..

Any document that is not in English or French must be accompanied by:
• the English or French translation; and
• an affidavit from the person who completed the translation; and
• a certified copy of the original document.

Note: An affidavit is a document on which the translator has sworn, in the presence of a commissioner authorized to administer oaths in the country in which the translator is living, that the contents of their translation are a true translation and representation of the contents of the original document. Translations by family members are not acceptable

Hi Omshri

As you can see, the requirement is not there for you to notarize the english translation. So, as long as you have...

1) certified copy of Original Birth certificate
2) English translation
3) An affidavit from the translator......does the affidavit mention the document/regn/file number of the original to tie the 2 documents?

you are good to go.

The translator has put – certified that this document from xxx language to English is correct, put his stamp and signed it. He is Government authorised translator.

Is this the affidavit by translator or something else I needed?

Was this translated in Canada or elsewhere?

I had an affidavit typed on a government issued bond paper - I am from India - indicating that copy is a 1)true translation and 2)true representation of the contents of document no. xxxxxxx.

I dont think it really matters if its on a plain piece of paper or not; you have to ensure that it addresses both their requirements. But it has to be a separate piece of paper.

Hence,

1) Photocopy of the original document (in your native language) - this must be certified using the exact wording CIC has provided. Since they have provided the wording, you must use it.

2) The affidavit of the translator

3) English/French translation - i had also notarized this (but it is not a requirement)

There are 3 documents that you have to submit.

He is government authorised translator of India

But I don't have separate affidavit, Does it mean above details are affidavit by translator.

Technically that would be an affidavit. Would CIC accept it?....your guess is as good as anybody else's.

See the CIC sit specifically mentions that you "must" send in all 3 documents. The sentences are joined by "and". However, if it is difficult for you to get an affidavit then why dont you just send this records and include an explanation of what you did and why you did it.

Also, to be on the safe side, if you could include copy of your 10th transfer certificate (which should have your name, date of birth and father/mother's name) that would further convince the VO that you are a genuine applicant.

BTW, what I think of that CIC mean for an affidavit is

People are doing translations to English without by accredited translator then in that case affidavit should be necessary

If translation is certified by an accredited translator then no need of affidavit

Am I correct??

Unless the translation is performed by a certified translator who is a member of a CANADIAN / Provincial translator's association, then the affidavit is required.

Yes it comes with the stamp from the notary, commissioner of oath or whoever makes it legit. I will suggest to look for a certified translator in your province, (I was surprised their service in our case was cheaper than back home) and you will be sure everything is ok for CiC
