Being Sponsored- Who fills out what? Please help ALMOST THERE :)

Hi everyone,
So after 3000 dollars down the drain, our immigration lawyer in DC went bankrupt and left us out to dry. We were so close to getting everything situated when we received a call from their lawyer stating they were out of business. Long story short- we haven't lost hope. My wife in Edmonton, Alberta decided to just fill out our own application ourselves and so forth, she filled out all the documents she thought were right, then airmailed them to me to finish and submit. That being said, I think there are some documents she was not supposed to fill out. Based on the link below, lets use that list as a template.

She (the Canadian born and raised citizen) is sponsoring me (the US born and raised citizen) as my wife (legally married in Edmonton last year) but in a relationship (with proof) for 5 years.

So to the facts. The documents she filled out were these in Red:
My question is- was I not supposed to be the one that fills out ALL of PART 2 and SHE fills out ALL of Part 1???

You are correct.

You(applicant) fills out Part 2 and your wife(Canadian Sponsor) fills out Part 1.

Note that both you and your wife have to sign and date "Application to Sponsor, Sponsorship Agreement and Undertaking [IMM 1344]" - this is the Sponsorship undertaking.

Since you won't use a representative, no need to fill out "Use of a Representative [IMM 5476]"

On another note, my understanding is when you go bankrupt, assets are sold and creditors paid. Since you paid $3000 and assuming you have a receipt, perhaps find out from their lawyer how you will recover your money. Have you been in contact with the Bar Association for DC to at least inquire about how to handle your situation?

Are you saying she filled out the Part 2 forms with her information or just completed them for you? You should fill out Part 2 as that applies to you and she does Part 1 as that applies to her. Practically it doesn't matter who actually fills out the forms as long as everything is complete and correct and they get signed in the right places by the right people.

Thank you both SenoritaBella and Harju- to clarify, she filled out the Part 2 documents thinking that she needed to as the sponsor. Meaning with her information and not mine. I am redoing the forms in Part 2 that are for me to complete and going from there. As I understand it- I am (even though she is sponsoring me) to fill out all of Part 2 forms.

IMM5406 has caused a lot of confusion in regards to whether or not you should list you wife on that form as your spouse. The majority of opinions here indicate that you DO include her as your spouse. Also, realize that step-siblings and half-siblings must be included on this form, not just siblings. I nearly made a catastrophic error, had I not noticed that one!

Also, make sure that you have the latest version of the forms as CIC often updates them!
