Hi all

I apologize if I become a nuisance but due to our soon to be send apps to Mississauga for spouse sponsor I like to ask of your opinion on the following
I am the sponsor and I live in European Union country (Greece) My spouse (common law) is from a neighboring country. She was ordered to leave Greece for overstaying her visitor visa more than 2 years ago.
No more consequences after this and she is still coming here on visitor visas again.
Now my question?
We are applying to the ministry of Justice of Greece to produce a non resident Police record which I am pretty sure that it will be mentioning her deportation.
We cannot and we do not want to withhold this information from CIC but do you people think that this could be a reason for not approving the sponsorship and finally her COPR.
Please try to give me a most accurate answer derived from your own experience as this is the last thing we would do before we are to send our apps. Our whole life depends on this

If this would have being a Visitor VISA (TRV) The Visa Officer due to fear of overstaying in Canada s/he mostly reject the applcation, but since this a permanent residence VISA, there is no problem as long as you explain why she was deported in details, because deportation can be due to many reasons, serious infectious diseases (such as many countries they deport HIV and Hepatitis patients), political , or other sensitive issues.

It will be useful if the reason can be shown on the Police record.

But i guess there will be some members that will be able to share with you their experience with such cases.

Thank you. She was deported only for overstaying her visa. nothing less nothing more! I do hope they (CIC) have an understanding on cases like this

I dont think it will be a problem. Many people are deported from Canada and still able to Immigrate once the conditions are met. Having said that, its hard to give an accurate reply since the vo's (visa officer's) have a lot of discretion.

I think that as long as you explain exactly what is written on the police record and why she got deported, it should be fine. There are quite a few applicants ( from the US for example) that are illegal in the US and have been admitted into Canada without problems.
AS you're applying to get a Permanent residence, I don't think that CIC will be concerned with a deportation for overstaying - it's not going to happen in Canada because it's a permanent one anyway...
Include a good explanation if the record comes back with something on it, and it should be fine.

I do not think the police check will show her deportation (by the way, was she deported? or did she leave on her own after the notice? These are two different things). Overstaying is an offense but not under the police jurisdiction. Although I am not 100% sure, so don't quote me on that. However, you will have to disclose this fact in the application and explain truthfully. Overstaying / deportation alone would not affect your application.

AnaMaria thank you too. Yes she was ordered to leave on her own and she was given one month to leave Greece. At that time they told us that she will be banned for 3 years but to our surprise when i had my lawyer check it no ban appeared and she resumed her visitor entries in my country.
Police record in Greece is called 'Penal Registry". This Penal registry contains any convictions that were recorded against you. So we'll be very anxiously waiting for them to send it to us.
I already wrote a document and explained in detail the circumstances that brought this deportation.

I may be wrong but I think this is not deportation. Deportation is, I think, when authority comes gets someone and forcefully make him/her leave the country. If she left on her own, it was not deportation. You want to double check with your lawyer. I'd rather avoid use of "deportation".
