Hi guys, I have a quick question. When you go to Peace Arch border crossing to apply for a work permit, do you need to have a US Visitor Visa? I'm currently waiting for my PNP and wondering if I need to apply for a US Visitor's Visa.

Hello everyone,

Would you please advise on this:

I got my PhD from UBC on Jan 2014, then PNP acceptance letter on July 2014 and then sent my documents to CIC on September 2014. I am still waiting for the file number and etc. After my PhD and about 8 month working as a postdoc I got a job in Ontario and I moved on October 2014. I have applied for many jobs in BC and had couple of interviews but not succeed going back to BC yet. Here are my questions:

1- What steps should I take to be safe?
2- Can I apply for Express PNP?
3- have you ever seen such situation and what will be the outcome?

If you are going to cross the border in US, you must have a US VISA, or else you won't be able to cross the border to get back to Canada!
You have to get out of Canada to cross Canadian's border again, and to do that, you have to get in in any country obeying the other country's policy. For example... if you want to go to Europe, many countries don't need to have a VISA to go there... which means that you can go there and come back to Canada. Got it?

It depends on what you intend to do when you get to the border. If you are just "Flag poling" for your work permit, then no.

Essentially what they do is unofficially deny (which sounds terrifying but it's fine) you entry to the US, give you a hand written piece of paper that states exactly that, you turn around and walk back to the Canadian border officials and give them said piece of paper they will began processing your application. I've done this 3 times at the boundary bay crossing and I've never had any kind of US visa. You just need to tell the US officer that you are here to flagpole for a Canadian work permit.

If you intend to head into the states for a few days however then you you require an I 94. Usually this will be issued to you by the BSA officer when you are at the border crossing. It's a green bit of card that gets stapled into your passport which allows you into the US for 90 days as a visitor. I can't remember exactly how much it costs but it's around 5-6 US dollars.

However I'm unsure as to what restrictions there are depending on your country of origin, so you may have to apply in advance. I've never applied in advance, I've just got one when I was crossing the border but I'm from the UK so I'm not sure about other countries.

My lawyer mentioned she has recently seen a tiny number of examples of people who are encountering problems after flag-poling. Technically you are being denied entry into the USA by doing this and she has seen this cause problems recently despite previously being fine for many years.

To avoid any potential risk she advised just get an I 94 and enter the USA properly - go shopping for an hour or something before coming back.
