Call CIC (I know how painful that's going to be) and ask them if they can give you YOUR UCI number over the phone. If they can, then have your husband call MSP back and provide YOUR UCI number to them.

Using the same argument that your `processing' has in fact started...even though it is NOT a requirement, might pacify them to get off their a$$!

I have my UCI#, and I can log in to e-cas, so I sent them the print out from my e-cas what says, that "the application was received..."
We will se when they call back that what else can they say...

Well if you had your UCI number from a previous dealing with CIC, such as a previous study permit or work permit, then my idea will have no merit. This would only work (maybe) if your UCI was assigned because of your Inland application.

The CIC explanitory table on e-cas indicates that "application received" is considered a part of the "In Process" stage! I also sent them this part of the CIC website. They do not put application received on e-cas if they have not gone through and reviewed the application package for completeness.

Be persistent with constant pressure in as calm a manner as possible. Best of luck.

Look at part 2: Deemed residency:

The following persons are deemed to be residents for the purposes of the definition:

(a) a person admitted to Canada as a student who,

(i) possesses a valid student authorization issued under the Immigration Act (Canada) before its repeal or a study permit issued under the Immigration and Refugee Protection Act (Canada), for a period of 6 or more months,

(ii) continues to retain such valid authorization, and

(iii) meets the criteria under paragraphs (b) and (c) of the definition;

(b) a person admitted to Canada to work who,

(i) possesses a valid employment authorization issued under the Immigration Act (Canada) before its repeal or a work permit issued under the Immigration and Refugee Protection Act (Canada), for a period of 6 or more months,

(ii) continues to retain such valid authorization, and

(iii) meets the criteria under paragraphs (b) and (c) of the definition;

(c) a diplomat accredited to represent another country in Canada who meets the criterion under paragraph (c) of the definition;

(d) a person who

(i) is a spouse or child of a resident if the person has applied for permanent resident status and as long as the application remains active


Since they cannot dispute that you have in fact submitted a PR application, and it is in fact active...you are deemed a resident, which makes you eligible for BC MSP.

I also sent them that table, highlighted the "application received" and the "in process" part together, and explained that the thing that I have my own site in e-cas means that my application for PR is also in progress... So, yeah, we will continue with the argue.

They don't seem to understand that both parts (sponsor and applicant) are connected and are, in essence, one application.

It's like a train; If the engine is moving, so is the caboose!

We just called them again twice, and they literally hung up, twice. No, for my biggest surprise, my husband wasn't rude et all, he just tried to tell them what's on their website and what's in bc law. They were speaking constantly, telling that my file need to be in process, don't let them interrupt, and say that as long as we can't provide more prove that we already sent, they need to end this conversation, and than hung up. That's insane, like we weren't in Canada...
I looked for our MLA, her office hours are from Monday to Thursday, we will call them Monday.

We got a phone call yesterday from the supervisor we left message to. At least she was kind and willing to listen to us, but she said the same, we need something more, even a letter of a transfer would be better than what we have, but the best would be if CIC could send us a letter stating that they are currently working on my app. We insisted that such a letter doesn't exist, and I wont get anything else till AIP. She will call the Ministry of Health today and discuss our case. I assume than this will be the final answer on our case.

My husband called the supervisor, she talked to the Ministry of Health, but got back with the same answer, we don't have enough proof. She said maybe she could do something if I had the letter of the transfer, or if my e-cas showed "in process". Now we can appeal to the Operations Director at MSP or the Medical Beneficiary Branch at the Ministry.
This is the same way as you fight your cases?

You should appeal anyway. The worst that happens is they refuse you once again, which is the same outcome as giving up.

CIC doesn't send anything anymore. Their own written documentation doesn't require this and the plain language reading of the law doesn't agree with their interpretation.

If you think it would be helpful, I'd be willing to write an independent opinion letter stating that their requirements are not in keeping with standard CIC practice. :)

So, I'd have to be added as a dependent to my husband's card, right?!
Looking on their website I couldn't find a specific form for this... should I send the application for enrollment?
Or I have to call them, explain my case and follow instructions?

You can do this online as well, though if his employer handles it, they will need the form version (which is what I linked).

Does CIC have some kind of statement or handout about their standard procedure? Something about that they don't send those kind of emails what MSP would like to have?
