Some advice would be good.A am married to a cuban woman.I submitted our application sept 6 was delivered sept 7.Last year i applied for her to visit Canada for a three month period.The invitation was rejected,explaining because she had no children,nor a house there,they believed there was a good chance that she would not return to Cuba.My problem is when we filled out question 9 on the background declaration form,where it asks, been refused admission to ,or ordered to leave Canada,i answered no.Now i think i`ve made a big mistake.Anyone know what i should do? I haven`t received anything from cpc yet

There was a section below those questions where it asks you to explain "If you answered yes to any of the questions above, please explain." Did you explain in that section about the application that was denied, or at least mention it? If you did, then likely they will not think you intended to misrepresent the facts of the matter, you just made a mistake.

OK, I just looked back at your question and realised you are asking about the "refused admission or ordered to leave" question. Question number 8 asks if you previously made application for a TRV, did you answer that one as "YES"? If you did, then there is nothing to worry about.

The reason is that the correct answer to number 9 is "NO" if she has never been to Canada. Being refused admission or ordered to leave is different from being refused a TRV. A person with a valid visa MAY be refused admission to a country or ordered to leave that country.

You may try to correct the form by completing a new one and sending it to the visa office when you receive sponsor approval and confirmation that the application was received at the visa office. This is pre-emptive and does not wait for the visa office to discover the error.

I am confused. Are you or are you not referring to IMM 5669 question 6 where it asks you a series of questions to answer YES or NO to? I do not see the question you are referring to anywhere on the IMM0008.

The question regarding "Have you or anyone in your application for permanent residence ever:
e) been refused admission to, or ordered to leave Canada or any other country" (check box YES or NO) is question 6 on the Schedule A/Background Declaration or IMM 5669.

Ah. You are referring the old forms! OK. Yes, Question 9.

Point 3, immediately before the point you are referring to, asked if you had ever been refused refugee status, an immigrant or temporary visa to Canada or any other country. If you said "YES" to this point, and then "NO" to the one immediately following (being refused admission or ordered to leave) then it is OK.

If you answered NO to everything, then, as I said, you can try to send a corrected version of the form after you receive confirmation that the file has been received at the visa office.

1) If you answered NO to that question, THAT IS OK BECAUSE SHE WAS NOT REFUSED ADMISSION TO CANADA OR ORDERED TO LEAVE THE COUNTRY.

2) IF YOU ANSWERED NO TO THE QUESTION BEFORE THAT REGARDING AN APPLICATION FOR A TRV, CORRECT THE FORM AND SEND IN A NEW ONE WHEN THE VISA OFFICE GETS HER APPLICATION. INCLUDE A COVER NOTE EXPLAINING YOU MADE AN ERROR IN ANSWER TO THE QUESTION.
