Processing time: they have mentioned that in those cases like my one the process is SIMPLE. They work keeping this in mind always that the minor child will live with parents in Canada and that makes the process easy - they can avoid some steps which are required in case the sponsored is adult.
Good to note that you finally got some clarity from CIC call centre. Like I said, there are some competent people working there ;).

I am sorry I don't really think people in this thread are in a position to answer that question. This thread is for issues in bringing over a child born outside of Canada to a PR of Canada.

Don't worry. You just land as ususal. You don't have to inform anything as the baby has not born yet.

So far I know you have three options:-

01. Come to Canada all together and let your daughter deliver the baby in Canada. The baby will become Canadian citizen before you all. There is no problem at all for the PR to come to Canada carrying baby. Only one thing to keep in mind that the airlines do not carry passenger with pregnancy of 7 months' or more;

02. You all come to Canada and let your daughter go back and deliver the bay outside of Canada. In that case, your daughter will have to follow the way we are following;

03. Inform your Visa office that you want to include the baby with you. In that case, your visa office will ask you to surrender the visas and send them the passports to cancel the visas. They will advise you to send them baby's papers once the bay is born. In this process, you all will have to go for medical test AGAIN before issuance of new visas. By the way, you will not have to wait for long time to get it done (may be a month or two after submission of baby's documents).

I would go with the first option definitely. I have shared it from my experience / knowledge - I am not expert and you should not do anything simply on my suggestion.

Hi tstarks, I've been reading through this forum and I really have to thank you for your contribution to this complicated issue. I am in the same situation and am going to apply for my daughter's immigration who is on a TRP. Now I was looking through the applications for H&C and am a bit confused, in terms of filling the application do I put my daughter's name on all the forms as the principal applicant?

Correct. Your child is the applicant. You can sign on their behalf as their guardian.

I have been reading on this for such a long time now and I must admit, it gets more confusing the more I read !. I'm currently in a similar situation where my wife, daughter and I are PRs and my son who was born outside Canada (after we obtained the PR) is now with us here in Vancouver on a TRP valid till April,2013 (enterd Canada in August 2012).
Now I'm trying to apply for sponsortship and I was under the impression that I need to fill out the "Application for Permanent Residence from within Canada – Spouse or Common-law Partner in Canada class (IMM 5289)" and mail it to Vegreville, Alberta. It looks like I need to submit a H and C application though from reading this thread !!. Will you please be able to advice and clarify this again ?

Hi all,

We are preparing to submit similar kind of application for our 6 months old daughter. Last month she entered Canada on Temporaray resident permit. Now we have to apply for permanent residence on Humanitarian and Compassionate Considerations.

We are little confused about the processing fees to be paid.

Can someone help to suggest which fees we must pay from the following table ?

Principal applicant = $475
Principal applicant, if less than 22 years of age and not a spouse or common-law partner (including a dependent child of the sponsor, a child to be adopted and an orphaned brother, sister, niece, nephew or grandchild) = $75
A family member of the principal applicant who is 22 years of age or older, or is less than 22 years of age and is a spouse or common-law partner = $550
A family member of the principal applicant who is less than 22 years of age and is not a spouse or common-law partner = $150

Are you sure about option 2 and 3? You advised me earlier in this thread to send my application to Buffalo office, which I did. This application was subsequently rejected and only resulted in lost time of a few months.

My understanding is that H&C is the only way to get a PR card for a child who is IN CANADA.

Updates:
12/July/2012 - Received request for medical.
28/Sep/2012 - CIC has received the medical and the next step would be an interview with an immigration officer. This should be "soon" according to CIC agent and is the last step to getting the PR card.

Unfortunately nothing further since then. We continue to play the waiting game.

My experience has been the H&C application. I have tried to do an sponsorship application to Mississauga stating Buffalo as processing center (on PMM's advice) and it was rejected. Please be careful who you decide to listen to and what course of action you take.

I have stated my experience and all the information I have based on my personal experience as a parent and the advice received from CIC.

1. What was the reason for the rejection? The child was admitted to Canada for 1 year on a TRP. You then had the choice of either Buffalo (Now CPP-Ottawa) or the overseas office responsible for the child's country of birth. H.& C applications show a processing time of 30-42 months. A sponsorship/application for a child is really quick through an overseas office, no background, no security, no criminal records check and a minimal medical exam. Unlikely to need an interview. The only problem would be if the child is an Indian citizen, is getting the passport there and back.

2. Here is the legal reasoning from the Regulations

Place of application for permanent resident visa

11. (1) An application for a permanent resident visa — other than an application for a permanent resident visa made under Part 8 — must be made to the immigration office that serves
(a) the country where the applicant is residing, if the applicant has been lawfully admitted to that country for a period of at least one year; or
(b) the applicant's country of nationality or, if the applicant is stateless, their country of habitual residence other than a country in which they are residing without having been lawfully admitted.

Part 8 doesn't apply as it is for refugees.

Hello everyone and thank you for all your feedbacks..
I hope you had all your issued resolved by now :)
well me and my husband have a similar case now....
We recieved our landing Visas in Jan 2012, the in Fenruary i discovered that i was pregnant!!! that was quite an unplanned surprise!! since this will be my forth pregnancy!!
Our plan was to land and premenantly move to Canada during the summer of 2012. we landed by that time, but my Doctor in my home country preferred that I go back deliver my baby there since he did my previous 3 c-sections and he was a bit concerned this time since i was having some complications.
So we came back to Jordan for the delivery, and i had my baby on Oct 16. well as my doctor predicted, i had a bleeding during the surgery and after the surgery in 2 weeks!!! but now all is fine.
since my kids are already in school now we will wait till ext summer(2013) to make the move again.
We r a bit confused regarding the sponsorship process....my questions are:
1. Should we apply for a TRV or a TRP so my baby can move immediately with us?
2.Can we apply for the PR from canada? and through which office? we r planning to reside in Toronto.
3.Can i (mother) apply for my child's sponsorship, even though i won't be working, and my husband would be the one with the job, but beacuase of his job, he would be travelling a lot.

I would really appreciate a clear and comforting answers since we r very concered about my child's PR and we really wish to finalize this and settle down in Canada...
