once you are Canadian citizen and one of the parents has generictic link to child. The child is automatically a Canadian citizen. You can apply for citizenship in india as well as certificate.

Not only are you responding to a post over 1 year old, but you are giving completely wrong information.

Even when the parents get their own citizenship, the child must be a PR of Canada first before the child can also get citizenship. A non-PR child will NOT get citizenship automatically when their parents get citizenship.

Hi All,
I need your help. My husband and myself are Canadian permanent residents since June 2016, but we have not been officially living in Canada because my surrogate is in Jamaica. She will be giving birth in February 2017 and we want to bring our baby to Canada to live. I am worried that my family will be separated and want to know the easiest way to bring a newborn to Canada. I have read that I would have to sponsor my newborn and that it may take 13 months. However, while doing this as a resident one of us must be in Canada to apply for the sponsorship, while the other person stays with the baby in Jamaica. I don't want to lose my residency but I don't want my family to be separated either. Any suggestions?

You have 2 options to get your baby to Canada.
1. Apply for TRV for the baby.
2. If TRV fails, apply for TRP

If both TRV and TRP are rejected, then you will be forced to separate family since 1 parent must return to Canada to submit PR app and live here during processing.

Thanks Rob_TO for your very quick reply.

I am wondering if i should try and get my surrogate to Canada to have her baby. Not sure if she would get the visa, but if she did... would this be the best option? how would we even find a doctor? is this illegal? Are there any penalties? We would definitely pay the hospital bill, no matter what it is ( maybe not all at once). Just don't want to lose the Canadian residency.

You could try for a TRV but unless your surrogate can show significant ties to her home country, it is unlikely to be approved. If she does get a TRV and is visibly pregnant when entering Canada, CBSA may refuse her entry unless she can show proof of funds to cover all care and birth costs.

To find a doctor or midwife, you would need to do the same thing as anyone else: call different ones and ask if they would take on a patient.

No, it's not illegal.

If you can't afford to pay the bill when due, you should not do it.
