Well we finally got decisions on our ARC. It was refused. I am heart broken :( My rep is shocked. They didn't give a reason only no compelling reason to move back to Canada. I wrote them a heart felt letter.
My husband has no criminality and no ties to terrorism. No clue why it was refused. They still have no made any decisions on our PR. I assume they cannot approve the PR without the ARC? Once they deny the PR we can then appeal it. Has anyone here appealed their PR or ARC decision? How long does it take?
So sorry to her that... You have to verify if you can appeal a negative ARC decision. If not, you can reapply.

How do you re-apply for the ARC? We can appeal the PR if we lose due to them denying the ARC.

First, You have to investigate if the Immigration appeal division has the authority to revoke a negative ARC decision so you dont lose your time and money.
If not, you reapply with another sponsorship and you include the new ARC request from the beginning but with new evidence, stronger reasons, etc.

Yeah we are going get the file and see why actually refused it. We have very strong reasons to move back to Canada. Only reason i can think have as the sponsor I'm not currently living in Canada, maybe that is why it was refused. I have spoken to different consultants they were suprised of thier decision since my husband does not have any criminality. Even our MP thinks there is discrepancy with thier decision.

Hello I am pretty latte in this forum but I am encontering maybe the same situation. I arrived in Canada in April 2013 and I was advised by a relative to apply for a refugee status which I did on a bogus claim and my claim was denied on it merit. in the mid time I met soemone we got married and we had a child she then decided to sponsor me. we applied for sponsorship in 2014 which was aproved but we never got a final answer.
in 2017 we received a mail from CBSA telling us that I was not elligible to Canada du to some allegation I made in my refugee claim (which was a bogus claim ). we tried to fitgh it during my admissibility hearing but the lawyer we retained was not really used to this situation (we just found that out after the fact) afterward we applied for a TRP but the CBSA officer in charge of my case did not allow me to wait for the result and I was deported on march 2019 wich has for result the cancellation of the TRP application. note that during all my time in Canada I was never charged with anything and I walways complied with immigration and CBSA I worked my way up from a fastfood job to a well paid job in the insurance industry with all the certification needed I even had a protected B license which you can only have after being investigated by the RCMP paid all my taxes since 2013 anyway I proposed to pay for my plane ticket but the officer insisted to have my ticket bought for me so I left escorted by 2 CBSA agent to my home country. those agent advised me on ARC but I haven't had much info on it. I have been in my home country for almost a year living on a well paid job but my heart stayed in Canada with my familly and I am wondering If an ARC is even an option for me and how hard it would be.
IF ANYONE HAVE AN ADVICE FOR ME

Hey guys pls I need help.. where did you submit your ARC to and how was it submitted .. Cos I believe I submitted an arc earlier on but the the visa office that handled it took it as a visitors visa and denied it due tho being inadmissible.. just need to know if the mistake happened from my end or theirs because I added the receipt of the processing fee and everything needed

Wow - that's very surprising and unusual.

Unfortunately PR is going to be refused without the ARC. I would check out the appeals thread for experiences. Appeals generally aren't a short process (i.e. expect at least another year).

Are you living inside or outside of Canada? If outside, maybe that's part of the problem? Order your GCMS notes...

I am living outside Canada. We spoke to our MP and she said to re-apply for the ARC. Wondering could the PR be approved and would need to do another ARC?? The MP read through the file notes and the notes had said they wondered why are living in Europe and how we are supporting out selves. I am dual citizen and din't think it mattered where we lived and thought there is no minimum amount to sponsor a spouse. It all seems odd to me. Why would it matter if I am living outside Canada. Other couple do the same and get approved.

Once we get our decision we will go from there. We will be ordering our whole file.

You only need to get one ARC approval.

To be approved for PR while living outside of Canada, you need to include evidence with your application that you have concrete plans to relocate to Canada as soon as the PR visa is approved. I'm wondering if this was a deficiency in your application? What evidence did you provide to show you would be relocating to Canada?

We explained in our letter our plans to move to Canada, I would go back to work in my old line of work, where we would live, what my husband would do for work. I showed strong ties to Canada, my family lives there, bank account, RRSP in both our names, business in my name and so on. We have been together for 16 years.
