Attorney v/s Self submission of application

Hi Experts : I recently got an OINP invite and was in process of arranging documents. Is it recommended to engage at attorney or self submission of application is also fine ? Has anyone done it by himself and succeeded ? Please suggest.

If you are confident you can do it yourself..their are numerous examples of people being successful by applying on their own. If you feel you cannot do, go for the attorney. This forum is great place to get all information you need. All the best.

I would suggest to you that unless your arrangements are extremely complex to avoid getting an attorney (the majority of them charge a high hourly rate) and if it's just for the purposes of filing an EE application you should be able to do it yourself. This forum I imagine started in part by people who either could not afford or did not want to pay money to attorneys.

My other suggestion is to put some money aside and don't spend it. That way if you submit an EE and get an ITA you are not rushing to save/earn/borrow money in the 60 days it takes to submit your application.

I have found all of the people in this forum to be polite, courteous and always willing to help or refer someone in the right direction.

Unfortunately there is no unambiguous answer to this question. Sometimes lawyer/consultant can really help with the application (especially in preparing employment letter/evidence or ruling out various issues) and it worth to have one... but only if you can find the good one. Many consultants/lawyers may do more damage to your application that you would be able to do by self.

As others have pointed out, this is a very personal choice. One that could have very important implications. So think through very carefully.

This being said, I'll share my personal experience for what it is worth.

We engaged a lawyer (Canada based) for our 2014 FSW application. We ended up having to 95% of the documentation work ourselves--some of that, rightfully so. But, in other instances (e.g., review of letters of reference), we weren't guided properly at all. To boot, this was a pretty reputed firm. We were told our job titles have to match word-for-word one of the job titles listed in our pertinent NOCs. Because of this, my spouse's employer refused to give a reference letter--citing reservations about attesting a job title that does not conform to the real one. Because of this, we provided a self-written letter with a lot of documentation (pay stubs, tax returns etc). We repeated asked the laweyer if this was a safe approach. We only got canned responses--it's up to the visa officer. It eventually didn't matter because our application was returned due to cap limits. However, knowing what I know now--thanks to this forum--I am confident that our application would have been rejected if cap was still open. Many of the supporting documents were very shoddy. One good thing that we got out of that experience--a good cover letter template for the LOE which I used for our EE application :).

No one else but you--not even a paid attorney--will be as dedicated to your application. My humble suggestion is that you go through the "Reasons for Rejection" thread carefully and start your prep work from there. I wish that this thread had been around when I applied; it would have saved me a lot of time spent trawling through various threads to figure out potential red flags. It's a treasure trove of information thanks to the generous folks who have taken the time to share the reasons for their applications being rejected. You'll be able to identify exactly what you need to do and, more importantly, what NOT to do, to put forth a solid application.

And, perhaps best of all---posts by Asivad. No lawyer/consultant comes close.

My job title is in alignment with NOC 2171 and description on my letter is also 75-80% same as NOC description. Do they have to match 100 % ?

Also, I have close to 8 years of NOC 2171 experience and I have letters from all the employers except the very first one (2006-08). Does that matter ? I have experience on employer's letterhead from 2010 onward.

Please suggest

I've created my profile using an immigration consultant and regret it. At times the response is slow and you are never in control of the profile as they use their credentials to create one on your behalf. I missed 2 draws when the cutoffs went down to 450 because the consultant was busy to create the profile.

EE process has made it very simple. I strongly suggest you do it on your and use this forum to the help you out with any issues that might stop you.

We learned from a friend (who had applied through a lawyer) that reference letters MUST address the first three description statements in the NOC and then as many of the other ones as possible. That's how our reference letters were drafted for our EE application.
