I know someone who has applied for a refugee In Canada and they hold a residency card of one of the Gulf countries . His refugee was accepted. They are not too strict on Syrians now. So if i were you , i would give it a shot . If they rejected you, they will most likely ask you to go back to the states.

As Scylla mentioned earlier, this is erroneous as the Third Safe Country Agreement (http://www.cbsa-asfc.gc.ca/agency-agence/stca-etps-eng.html#a2) clearly states that the OP must apply for Asylum in the US, and can not apply for asylum in Canada via the U.S. unless he/she meets one of the exceptions (family member in Canada, valid Canadian visa, etc.).

In the same situation, what if a person holds a Canadian transit visa and has a ticket via Toronto to US but applies before arriving to US, right at the Pearson airport? Will they still send him to US? Even though he's not applying from land border? What are the chances they will consider him?

In this case, person can claim refugee status in Canada on landing at Pearson. Chances of success in getting refugee/protected person status eventually? Your guess is as good as mine.

You cannot apply for asylum from Pakistan personally. If you wish to seek asylum personally in Canada you must do so from a POE (Point of Entry). This means you should get a visa that would allow you to come to Canada and when you land, you can make your claim for asylum with the first CBSA officer you encounter.

If you wish to remain in Pakistan and file for asylum, you will need to do as Scylla suggested in previous posts and contact the UNHCR to be recommended for asylum status. Whether or not the UNCHR feels you require asylum is up to their rules and regulations and nobody on this forum can advise you in that regard.

Is it important to have a family member in Canada:

In general term the answer will be NO it is not important to have a family member in canada to claim protection. blood relative/close family member requirement is only for those who claim refugee protection at USA-CANADA land border. people who make refugee claims inside canada or come to canada by air do not need to have family members in canada.

Refugee claim at US-canada border: people who are in USA (e.g on visit visa. legally living, studying, illegally living etc ) can come on Canadian border and claim a refugee protection (assuming they do not have a visa (TRV) to come to canada). to claim a protection at Canadian border they must have a close relative (spouse, children, parents, brother, sister, uncle, nephew etc ) otherwise they cannot. the reason is as you are already in USA (a safe place) you must make your refugee claim at the first safe place BUT if you have close family you can choose to make your refugee claim at Canadian border to facilitate family reunion. where to make the claim: at Canadian border where they have a RPU (refugee processing unit).

Refugee claim at Canadian airports: any person entering into canada legally or illegally can claim protection/make a refugee claim at airports. for such claim there is NO requirement of close family relatives to be present in canada. where to make the claim: at the airport when you meet the first CBSA officer/immigration officer.

Refugee claim inside canada or once you are in canada: any one who had entered in canada on visit visa (trv), student visa. is already in canada etc, etc.... can make a refugee claim while he is here in canada and he DO NOT need any family member to be present in canada.where to make the claim: You can make a refugee claim in Canada at designated CIC offices which are in almost all major cities.

If you have a family member in canada does it makes the refugee/asylum case stronger:
NO it does not. refugee case is accepted or rejected only the basis/reasons of your claim. a refugee case is only strong if you are unwilling to return because of a well-founded fear of persecution based on race, religion, political opinion, nationality or member of particular social group.
IRB can no way grant you refugee status only for the reason that you have family members living here.

Some of the united states are easier on Syrian's refugee, new Jersey is one of them.

If you were accepted in Canada, you will be able to work,study,and get some financial help through the provincial government. But don't look up for that. It is never enough, so you need to be productive in the community .

You can always go on facebook and find Syrians community in Canada,or USA .They have stronger experience.

Keep in mind, there are lots of negative people on this forum,and only few accredited people. So keep asking and don't rely on this forum and ALWAYS take risks.

Besides if anyone holds a chip on their shoulders about refugees that would be the conservative government. You do understand that every new refugee that comes to Canada has to be supported by the Canadian taxpaying base, right? So, in effect, they are carrying the refugees on their head, as you put it.

Do you want me to list the canceled projects !!!!.Don't you notice increases on the road constructions prior to the election. There is a single street in my city, they have worked on that street four times this year in different occasions, and everytime i ask what is new, the answer is total BS. I am not saying Canada is obligated to help refugees,but please don't play " taxpayer money" card with me !!!!. Conservative initial spend on the airstikes was 90 million $,this money could'v helped our northern fellows more than what has it done in Syria or Iraq, oh no wait, uncle Sam said we have to go,then we have no choice. How many schools could'v been built in Canada with this money or educations funds,or transportation projects. Have you ever been in Japan and see their subway's routes. A small project on 401 takes ages to be completed.

So please dont give me this profile dislike non-sense logic.Yes Canada is not obligated. Lets start by how much has your so called Middle Eastern brothers helped you in all this crisis. Lets start with Saudi, UAE, Qatar, Oman, Bahrain and some of the Arab countries in the region. Why havent they taken any Syrian refugees? You gotta remember refugees similar to beggers dont have a choice regardless of how rich or talented they are. Canada is doing its fair share if accepting refugees which I think is beyond generous.Lets start with neighbouring countries, why arent they doing enough? Yes, what i am trying to say is that Canada should help and contribute more in saving lives and people in need-no matter who they are-.
GCC countries have resettled many Syrians who were on temporary visas,and built many refugee's camps around that area. Turkey has welcomed around two million Syrians,Jordan 800,000 , Iraq 280,000, Lebanon one third of its population are now Syrians, Germany 800,000, Sweden really high number, France,Norway,ِAustria,and Finland have opened their borders recently to Syrians.

Anyway, i wish if this war hasn't started.
