Arranged employment / Canadian work experience question

Hi everyone!

I recently received an ITA under Canadian Experience Class and I'm currently in the step of uploading supporting documents.
I have a valid work permit and I've been working in Canada for 1 year so under "Intended work in Canada" I selected that I have a valid job offer. I also added the 1 year of Canadian experience for the same job under work history, which means that I'm claiming point for Canadian work experience and arranged employment with the same job.
Now it looks like I need to upload 3 different document (Offer of Employment - Employment record - Letter of employment) for my current job position. Which made me question if it's possible to claim points for both experience and arranged employment with the same job, some threads suggest that arranged employment should only be for "future" job that you're going to start, not for existing one.
so my question is: Can I claim points for Canadian work experience + arranged employment with the same current position?
if yes, what is the difference between Employment record and Letter of employment for this particular job?

As per this link, a work permit on its own is not a job offer, even if it is an open work permit. So you cannot claim points for intended future work with your current employer, unless you can provide a job offer + LMIA (unless you're LMIA exempt).

You are fine. Your employer should provide an offer letter along with the LMIA and a separate experience letter for the past experience.

Got it! do you know if I can just use the initial job offer that I used 1 year ago for my work permit? It’s stated in it that it’s for „indefinite term“

• made by one employer
• continuous
• paid
• full-time (at least 30 hours a week)
• for at least one year after we issue your permanent resident visa
  • not seasonal
• in a job that is NOC:
  • Skill Type 0 or
  • Skill Levels A or B

It also must be made :

• by an employer with a new positive LMIA that approves the offer and names you and your position OR
• if you’re currently working in Canada in a NOC 0, A or B job on a work permit that was issued based on an LMIA, and:
  • you’re working for an employer listed on your work permit
  • you’re authorized to work in Canada on the day you apply for a permanent resident visa, and when the visa is issued
  • your current employer made you an offer to give you a full-time job for at least one year if you’re accepted as a permanent resident OR
• if you have a valid work permit for a NOC 0, A or B job that is exempt from needing an LMIA, and you:
  • are currently working for an employer specified on the work permit
  • have one year of full-time work experience (or an equal amount of part-time work) for that employer
  • have a valid job offer from that employer for at least one year after we issue your permanent resident visa

Based on what I highlighted, I think your LMIA should be valid as long as you get your employer to write you an offer letter guaranteeing your employment for a year after you become a permanent resident.

It's a bit of a grey area. I don't think an employer can ever guarantee keeping you in a job for at least 1 year as its unreasonable. So technically speaking, having the word indefinite should be enough, but I'm not sure, so don't take my word for it.

is that valid even if into implied status?

I asked for the renewal of WP issued from LMIA (which allowed me to get 50 points), then it expired and I got an ITA while into implied status.
We got a new LMIA as well, but after the invitation.

So my question is:
Are all these features you highlighted valid under Implied Status as well?
I did not find anything that can fits this situation

Hi, guys I would to know how can I get the 5 points for "Arranged employment in Canada" under Adaptability (maximum 10 points) for the Federal Skilled Worker Program? If I get this I will get 67 points and be able to pass the Express Entry Submission

My closed work permit is already in process and GSS-LMIA Exempt submitted by Employer (Thru Representative)

Hi HSAL, I'm in exactly the same position as you. I have been working in Canada for 1 year from my employer (in the same role) and have my initial Job Offer (I was LMIA exempt). I received my ITA with points for the job offer and 1 year of work experience. Now I'm considering declining it after reading this post.

What did you end up doing? Did it work?
