Where does is it state or imply that your 4 years will not be taken into account. It doesn't specify anything. This is a General statement -" the final decision will be made according to your documentation".

So, how do you know they are not going to consider the extra months to get you to 4 Years?.

If you look at the clause, it states clearly:

• take into account any years of experience that occur between application and assessment,
and for which the applicant has submitted the necessary documentation (R77).

Whilst obviously not intending to be rude nor offend any body, person, office, any living soul, or any person directly or indirectly, and with all due respect,
We are being asked to take IELTS and they don't understand a simple statement of theirs?!

i am positive that the do final decision according to my documentation. if my documents shows 4+ year experience then i am hopeful they must consider it.
Anyway i would be able to give you confirmed answer in coming 3/4 weeks as i am expecting my point assessment letter in coming 3 to 4 weeks then it would be crystal clear for you guys.

I would appreciated if your give your views on my case regarding experience issue. I am posting it again for your kind consideration and advise.

I have had three employers in the last 10yrs eg. A,B and C. At the time of submitting my application the 1 year experience requirement was met with employment A although I was in employment B (six months) and at the time of updating documents in employment C. I have three yrs experience in employment B. I did not update documents form employer A as I had a dispute with him. I have sufficient points from employment B and did not require points form employment A (when updating documents). My question is will CIC still contact employer A. My fear is that he may not give a positive feedback. Will this situation jeopardise my case or will they ignore my employer A (no documents updated).

Your help is much appreciated.

In my opinion, as long as you did not do anything "Criminal" in that employment and there is no case pending against you in the Employment A, then there is no cause for Alarm.

Secondly, and this is important, as this is the employment that fulfilled your 1 -Year requirement, the IO responsible for your case may want to see the proof of what you claimed, i.e having worked there at the time of your application.
This, Experience period, "in my view is locked", as it is due this experience, that you were sent an AOR. (enabled your application to be processed further. (I don't know, Depends on the IO, I think.). If I were you, I would have, at the least, put in My pay stubs, My employment letter, tax return or anything that would backup that employment period.

It's up to the CIC/IO responsible for your case to carry-out the necessary research and actions to reach a decision. Most likely they will contact him, at the least, make a phone call to find out whether you were employed there or not within the period claimed by you.

I doubt if the IO is/will be interested to know/find out about your Character or behavior. That, I think, is left to be concluded from the PCC of a country.

Let's see what others have to say.

Thank you very much for your views and I think the concerns you have expressed are fairly reasonable. I am keeping my fingers crossed.

I did not have any criminal issues, just dispute over unpaid wages and work burden ..... I had to quit without a notice. At the time of quitting that employment I had never thought of applying for canadian immigration (I applied one and half years later). The wages were paid in cash and no contract, IT returns etc. Basically I went in for further education ...... just got one letter from him after a lot of pestering stating the time period for which I worked for them. At the time of application I submitted a notarised copy of it and although the address remains the same the telephone numbers must have changed over years (more than several years now). So they will not be able to contact him on phone. May be interview call?

Anyway, thanks a lot for your input on the issue. If you have any other advise on the matter I will really appreciate.

Well, from what you have stated here, I would not worry too much about it.

The worst case scenario, in my view, is like you asked, may be an interview, in which you will be able to explain and eradicate any doubts and issues verbally.
