Hi Decoy and Gary, appreciate your prompt response. Anyways, in regards with my visa application, I believed that we had met the following:

1.Demonstrate the genuineness of your relationship
-We had provided proof of relationship such as letters since 2011, phone calls, gifts, photos..

2.That you have existed in a marriage like commitment and
-My bf had supported me financially and emotionally. I included remittance forms since 2012 up until this year

3.For extenuating reasons beyond your control, you are unable to marry or cohabit for 12 months.
- In our situation, there's no way we can be together since I am still married. Had an annulment but got denied. I applied for tourist visa in Canada year 2013 but also got denied.

I believed we had exhausted all avenues to be together but wasn't given any chance.

I'll be glad to know your perceptions on this matter. :)

Denela, what makes me concerned is that the CIC could still say your partner could live with you for a year to establish common-law. The CIC is very very picky when it comes to conjugal. I think your proof of relationship is solid, but unless for some reason your partner was inadmissible to the Philippines and couldn't even enter the country to live with you or other circumstances that would 100% prevent him from living with you establishing common-law would still technically be possible, even if it would be difficult.

I would definitely make your own thread to get input from some of the senior members here who have more knowledge on conjugal cases.

If you haven't spoken to a immigration lawyer or consultant, maybe see if you can set up a meeting and get their opinion on number 3.
I read that a couple cannot get a divorce unless 3 years have passed. An annulment can only be put forward under certain circumstances within that 3 year mark. However after 3 years of the marriage date, a divorce can be filed.

With that marriage still existing in Singapore, the application will be very hard to approve.

You're welcome. I'm sorry to be the bearer of unease though in this case. Definitely make a separate thread and ask for expert advice. Applying as conjugal is sometimes trickier than it really should be in my opinion, especially in cases like yours.

And as someone else just said, in your case it might be best to hire a reputable immigration consultant/lawyer.

I think you have a fairly good chance of being approved. I've seen quite a few Filipino applicants be approved through conjugal, because that's the only country that does not allow divorce. If I'm not mistaken, it's a crime for someone who is still married to live with another partner, so there is a legal barrier to becoming common-law.

I would recommend that you try for another TRV, to show that you are continuing to make the effort to live together, but are unable to for reasons beyond your control.

Note: I'm not an expert on conjugal.

Oh, I didn't know that it was technically a crime for someone in the Philippines who is still married to live with another partner. That would certainly be a legal barrier to establishing common-law since Denela has also been refused a TRV. Based on that I'd have to agree that it's likely their case will succeed.

They will want to know what the support arrangements are with that child. If there are none make sure you state it is at the mothers request as they may become concerned that non support is a pattern with the sponsor.

Amazing the things you learn on these forums.

Danela, seek further clarification on the main forum. Post what youve posted here, and say all the barriers to you going to canada and your husband going to the Phillipines. Youre not alone. Theres probably someone here who's been through this exact thing.

No news for me today. A March 29 applicant who hasn't received SA yet has "In Process" on their PA side with a 3rd line saying they started processing their application (it looks like the application has already been forwarded to Ottawa) Maybe the CIC is just being sloppy about SA notifications right now.

That's at least some good news! I'm 29th of March applicant as well and don't even have a second line yet. But that gives hope :)
