Hello,

Would our application get returned if we applied for spouse sponsorship not having the meds done and without the police certificate? Thank you.

Likely not, but there's never a guarantee. Just put a note that it will be coming later. You should try to have everything upfront in most cases though, just saves hassles and time in the end.

No it will not be returned to you but as these guys mentioned it's better to send everything from the get go. I personally submited my app without them and it wasn't returned

You can check CIC IP-2 and IP-8 ("When does an application exist"). It states:

"An application in the spouse or common-law partner in Canada class requires receipt by the CPC-
M of a properly completed and signed Application to Sponsor, Sponsorship Agreement and
Undertaking [IMM 1344E], a properly completed and signed Generic Application Form for Canada
[IMM 0008E] including the Schedule A Background/Declaration [IMM 5669E] and proof of
payment of the correct processing fees. Under the spousal policy, H&C applications with a
spousal connection will be considered applications in the spouse or common-law partner in
Canada class after the receipt of a sponsorship, if not already submitted.
"

If you have correctly filled IMM1344, IMM0008, and IMM5669, and paid enough fees, they will start processing. No mention of meds or PCC.
 
Thank you so much for the information. I'm a student in the US, so I need to go through the FBI and that takes months!!!! (I'm not a PR) no way I was going to wait until that was done haha!

You should have the medical done before the application is submitted.

If you are sending it without a PCC, include a letter of explanation and proof that you've applied for it.

Not a problem at all.
Your application will never be returned for that reason.
But it could cause in delays.
 
If you are filing outland and are a US resident, you should look at IMM3910E. That is the guide for US Citizens and it includes a checklist for everything that is considered to be a "complete" immigration package. Failure to include any of those items COULD result in your application being returned as incomplete. As others have stated, they have successfully managed to bypass this, but this is YOUR immigration package. It is up to you if you are willing to take the chance that the person receiving your package is going to look at that list and say "Meh, close enough" and stamp it received or if they are going to say "Nope, missing information, return it".
 
You can't always go by what the official documentation states, because they are never consistent. One person posted here their application was returned for not putting "N/A" on the checklist items that weren't relevant to them. So while it's unlikely to be a problem, as I said, it's better to put a letter in stating it will be coming later. And unless you have some major issue with the medical, do it upfront if at all possible.
 
I have my own question relating to those last two responses from Aquakitty and Alurra71.

My question is: ok, so we can't trust the operations manuals by which CIC officers are trained and refer to. So my questions are these:

If we cannot trust those manuals, how can we trust the guides? What gives credance to the guides over the operation manuals? Also, I believe that was in IRPA as well, but it's been a while, I could be wrong here, so don't quote me.

I am happy to accept they are wrong, but what becomes and what delegates the source of truth then?
 
I have a friend who applied without medical or police certificate (she is Mexican citizen but US Permanent Resident), they provided a letter explaining why these document can't be provided and they will be submitted. Application was accepted, OWP was issued in 4 months after sending ALL the documents.

It simply comes down to the person reviewing the file and whether they apply the rules exactly or to their own interpretation. This is why some have their apps returned if they are missing one form, while others missing that same form are just requested to send it in.

Agreed. However that means that CIC's statements, and the Auditor General's reports' statements regarding defenseable behaviour within the CIC with respect to case assessment is a lie. This is the problem...
 
I made the mistake of waiting 4 months for the police certificate to arrive to send in my application. Now it looks like they don't even have it (or can't find it or didn't scan it in) and at this point it's expired so I am doing it again. I would say it's best to submit without. If you have to wait 4 months to get it then worst case scenario it gets returned and you resubmit with certificate, but best case scenario it gets accepted and you don't lose 4 months on your application.
