Applying to Buffalo. Minimum stay requirement in USA. Experts help

If experts can help me understand that will be great.
We entered the USA in Mid August 2009. Our renewal / extension to stay in USA is in process and we shall be living in USA for the next 3 years.
Now, currently the principal applicant has lived only 8 months and can stay for another 3 months. So, if the principal applicant residing in USA receives the extension can he / she apply to buffalo or he / she has to wait 11 months plus 12 (extension) before he / she is eligible to apply for Canadian PR.

Please help me understand the rule.

once you have received the extension for longer than a year, then you may apply even if you haven't been in the US for a year.

you should have been legally admitted in US for one year...doesnt matter....like if u entered Us in January for one year...then u can apply Pr in January or in November...
