I am originally from the UK but in a common law partnership with my Canadian spouse, and we have been living together for over 12 months now in Canada. Therefore I am just about to start the application for sponsorship for permanent residency over here. I am currently on a working holiday visa but that expires in 12 months.
Therefore I know the timing is tight & I have both been told and read on here that by far the quickest way will be to apply outland. However I am a little confused with this and so hoping someone can help me please with my questions.
1) Am I still allowed to apply to the High Commission in London, even though technically I reside in Canada?
2) On the CIC website it gives me 2 choices for accessing the correct application kit:
a) If your spouse, partner or accompanying dependent child lives with you in Canada, use the Application for Permanent Residence in Canada—Spouse or Common-law Partner.
b) If your spouse, partner or dependent child lives abroad, use the Application to Sponsor a Member of the Family Class.
Which one do I select if I want to apply outland, given the fact I do actually reside in Canada at the moment? Can they reject my application in London for the fact I live in Canada?
3) If I can still apply outland where do I send the application? Still to the processing centre in Mississauga or does it go direct to London?
Really appreciate all help anyone can give as just starting this process and feeling a little overwhelmed!
