hello everyone , need help from seniors to know about permanent resident process.we are in common in law since one n half year. now i m applying PR on behalf of my husband. he is canadian citizen but he work overseas . would it impact on PR process? looking forward to hearing from seniors . please n thanks

when you say working overseas, do you mean he is stationed there for military purposes or is overseas because of a work assignment? if he's on a work assignment, does he come back to canada at all or is he out of the country permanently? once your approved for PR, does he intend to move back to canada or will he be living in another country?
Hi there, actually he is starting new business in another country. So most of the time he has to travel. He don't have any business in Canada. Before start business he was working for small group. He is planning to setup the business here too but it might take couple years at least. Any suggestions would b appreciate.
if he doesn't intend to move and settle in canada upon your PR approval, then chances are the pr won't be approved and it would be a wasted effort. part of the application for sponsors living abroad is showing proof of intentions to settle in canada immediately upon approval - for both the sponsor and the applicant.
there's really no point in applying for pr until he intends to move back to canada.

As the person said above, apply for PR when he is really ready to move back to Canada. Until then, enjoy the travels!
Thanks a lot every one for their kindly effort. Another question I have, I am pregnant woman and not working right now, expecting baby in couple weeks. He is on low income right now because he is not making any money here. On the other hand he is not taking EI or CPP benefits either. We files taxes together this year for 2015 and will file together for 2016. As both of us would be on low income, will make any issue during PR process??. Thanks in advance

i'm not sure what you mean by low income. do you mean welfare? as in the government gives him money for living expenses? if so, then he won't be eligible to sponsor you. sponsors can not be on welfare.
if you mean he earns a low income from other sources, not including welfare, then it doesn't matter. there is no income requirement for spousal sponsorship. In the application though, CIC will want to know how he plans to support you while you get on your feet. examples are money saved, support from family, etc. Welfare is not an option. they want to be sure you WONT be going on welfare when you get to canada.

Hi there, thanks for comment though. I live in Canada too but my status is student visa. Yup he is not taking any welfare from government. I am allowed to work also but right now due to pregnancy I m on maternity leave. What do u think? Looking forward hearing from u soon. Thanks again
again, there is no income requirement, so as long as neither one of you are on welfare and you thoroughly explain how you plan to support yourself, then more than likely there won't be issues. no one can tell you exactly what will happen. you will just need to submit your application and explain your situation as clearly and thoroughly as possible. maternity leave has nothing to do with it. if you can work later, then tell them your plan to go back to work.

Seems to me, most have misread your original post. Folks, the husband that is abroad IS the Canadian citizen. He can apply to sponsor the OP's application for PR . . . no problem. It is only PR's that must remain in Canada when they sponsor their spouses.

therefore, a spousal sponsorship will most likely not be approved unless they can prove they BOTH plan to settle in canada immediately upon approval. it's quite clear he is a citizen. yes he can apply while not in canada, but CIC will most likely not approve the application unless he intends to move back to canada immediately upon approval of pr. there is no misunderstanding - my advice is not about whether a citizen can apply to sponsor while outside of canada. my advice specifically states if he doesn't intend to SETTLE in Canada IMMEDIATELY following approval, then it most likely will not be successful. when has cic approved a spousal sponsorship for someone living in canada when their sponsor is living and working in another country and does not intend to return to canada for a few years? Hi there, I m back with another gentle question. My applications are ready for permanent resident and open work permit as well. I got the photographs as per requirements for both applications. just wondering pictures for both applications has to be same size? Another thing I want to know do I have to write or print my name back of photographs.
