Hi..All,
i have a question, that presently i am in canada on a closed work permit i applay PR under CEC on Jan 2013 . got my AOR on feb.2013. my current work permit is valid till december 2013.my family also here with me.as an open work permit.
right now i am out of work because of some issue with my employer. so i would like to know that am i able to apply for BWP right now because i am on closed work permit and need to take care of my family. and it is very hard to stay with out job. also if get BWP i can find a good job before i get my PR.

ANY ONE IS IN THE SAME SITUATION.
I NEED YOUR HELP. IF I APPLY NOW IF I GET REJECTION. I AM I ABLE TO APPLY AGAIN?

Yes, you can go ahead and apply for BOWP now. All you need is your AOR (which is already with you.) There have been a lot of members on here who have been in the very same situation as yourself and have applied and successfully received their BOWP. You can apply online for it.

Also, depending on the fact if whether your employment was terminated with or without cause and or if your have voluntarily resigned, will determine if you are eligible for EI.

You can only be eligible for EI if you were laid off (employment terminated without cause), if you were terminated with cause or if you voluntarily resigned from your job, you will NOT be eligible for EI.

Thanks, do i need to provide any letter to the officer explaining my situation that why am i applying early
 
Yes, that would be very helpful to write a letter explaining your case.

you can only apply 4 months before the expiry of your work permit for BOWP so as long as you are in that period, you don't need a letter and if not, then you cannot apply.

Yes you can apply!


If you have gone through BOWP threads on this forum (i know there are couple, check the ones started in Dec 2012 and Jan 2013), you will find that applicants with WPs valid for as far as 12 months - got BOWPs.

So the 4 month criteria is not being applied across the board. As Cruiser mentioned, the key factor for an officer ignoring this rule is the employment condition of the applicant. Those applicants who were successful in getting BOWPs while have a valid WP expiring beyond 4 months, were either being laid off in few months time, companies closing down or something of that sort. You will need to explain this in a cover letter. If you can get a letter from your employer reasoning the circumstances of the termination of your employment - that will be additionally awesome!

But this thing is for sure, that you can still get BOWP even when you have a valid WP permit expiring well beyond 4 months.

In case you are rejected. What's there to loose, $150 only! But you can still reside in Canada legally till the end of your current WP. This BOWP application will have no impact on that.

Another 150 bucks for the spouse who's in Canada on an Open Work Permit. Some more bucks in case the OP has children with him/her here on Open Study Permit/s. But in the OP's case who presently doesn't have a job, it's worth to give a try applying for BOWP.
 
I doubt though if CIC would approve the BOWP application (with beyond 4 months validity of wp at the time of application) when the reason for early application is unemployment caused by voluntary resignation. Did you voluntarily resign from your job?
