Hi Spaceexp.

I understand what you are saying.
But in practice, once the OUTLAND office figures out that the two of you are living INLAND, won't they take their time in processing the application?
Or will they process it just as fast as if you were actually living OUTLAND?

Does anyone have real-life times on this?
For an outland application, visa office does not care whatsoever where you live. It makes absolutely zero difference in the processing time.

no absolutely not. inland and outland are 2 completely different applications and have nothing to do with eachother. if an application is in OTTAWA or a foreign visa office, it will NOT automatically turn into inland just because the applicant happens to be IN Canada. INLAND applications are processed in Mississauga. Outland has NOTHING to do with WHERE the applicant is currently residing, it has EVERYTHING To do with where the applicant is FROM and which visa office the application is processing at.

Yes, there are certainly real-time times on applications being processed in Ottawa. The blue link in my signature is for the Ottawa spreadsheet. Note there is NO significant difference in processing time just because the applicant is in Canada during processing. US applications are averaging 6 months processing times. Delays in applications have to do with how many requests CIC makes during the processing or whether there is an interview called, that is IT!

I will just add that I am "visiting" Canada since July (halfway through processing), my VO is aware of that, and it didn't influence the process. I am not the only one either. I wouldn't be worried about that at all.

I think you didn't understand me right. No matter which country you are from, you can be INSIDE Canada but apply OUTLAND. If Outland processing time for your country is fast, most members of this forum would recommend you the outland option. You can check the processing times for different countries here:

Bear in mind that the processing time depends on your case, so the time shown on cic website might not be applied to you (it may be faster or slower, depending on your case).
I really don't understand this. It clearly says on the CIC website

"If your spouse or partner lives with you in Canada, use the Application for Permanent Residence in Canada—Spouse or Common-Law Partner. Note: if a child of your spouse or partner is also living with you in Canada, they may be included on the application if they meet the definition of dependent child.

OR,
If your spouse, partner or dependent child lives outside Canada, use the Application to Sponsor a Member of the Family Class."

My husband lives with me in Canada, I am a Canadian citizen. How can we apply Outland just to make the process faster (Brazil) if we live together in Canada?

You use the second set of forms (outside Canada), but you indicate a Canadian mailing address.

It also clearly says on the website that you can apply outland if you want to advantage of the faster processing times.

there is absolutely NO rule that says that a person IN canada can NOT apply outside of canada. in the inland guide (overview section), it actually RECOMMENDS applicants to apply outside of canada to enjoy the quicker processing time. there's nothing to be confused about. a person can be IN canada as a worker, student or visitor and apply outside of canada. applying outside of canada has NOTHING to do with where the applicant is physically. it only has to do with which visa office processes the application and where the applicant is from. On the contrary, ONLY those living in canada can apply within cnada. it is not the best choice for most people, especially thouse who are visa exempt. the fact that CIC even states in the overview section to apply outside of canada suggests they are trying to limit the amount of inland applications seen.

see here:
http://www.cic.gc.ca/english/information/applications/guides/5289ETOC.asp

taken from guide 5289:

The family class is aimed at faster processing of spouse or common‑law partner applications from applicants outside Canada.

Processing times for spouses or common‑law partners in Canada are generally longer.

The person being sponsored can apply to a visa office outside Canada to take advantage of the family class processing standard. Processing times for applications processed in Canada are posted on our Web site.

No, outland applications are processed based on outland timeline (although usually much quicker than posted). It doesn't matter if both sponsor / applicant are living in Canada or not.

Nope, they don't. I've been with my husband the whole time. I come and go as I live in the States. They process it as an outland application even though I'm visiting in Canada. Luckily, they don't say 'well you are visiting in Canada so you have to send in an inland application'. Nor do they slow the process down. i don't think they can legally. They file it in due process just like everyone else. They don't just keep you in the rear of the queue and bump others up because they happen to be outside of Canada. It depends on a. when you submitted it b. the order it was received and c. how straightforward it is. As far as real times, it depends on your visa office, look at threads specifically regarding your Visa office or the threads pertaining to the time you submitted it. They will give you a better time frame. I hope this helps.

Hello,

I do have a question here. If I apply for PR outside Canada and live in Canada, Could I still apply for OWP once AIP is approved?

Thanks,

Technically there actually is an AIP process that happens sometime during the outland process, although unlike inland this is not communicated to the applicant, and it is called "AFP" (Applicant For Permanent Residence).

So for people living in Canada yet applying outland, after their processing at the outland visa office gets to the AFP stage, they would then be eligible to apply for OHIP to start the 3-month waiting period (there's a big post on the topic in "health" section of forum).

Still can't get a work permit though.

I have another question.

Once your application is approved, what document would you be received? I meant for the outside applications. How do they land? Are they required to leave Canada and re-enter?

It has been a while ago and I applied inside. My friend asks me regarding sponsorship applications but I am not too sure about her questions..

Those applied outland will be given a COPR in the mail to take with them to land in Canada. If they are living in Canada, they can exit Canada and then re-enter to activate the PR landing and granted PR status.

If applied inland, they will get a landing interview letter in the mail to show up at the nearest CIC office. They will get their COPR at the office and become PR.
