Hi experts,

If my wife and I both live in Canada, do I have to apply PR within Canada? But the processing time is too slow when apply PR in Canada.

You can be inside Canada but apply as OUTLAND. This is usually a better option (depends on the country you are from).

I think you didn't understand me right. No matter which country you are from, you can be INSIDE Canada but apply OUTLAND. If Outland processing time for your country is fast, most members of this forum would recommend you the outland option. You can check the processing times for different countries here: http://www.cic.gc.ca/english/information/times/perm-fc.asp

Bear in mind that the processing time depends on your case, so the time shown on cic website might not be applied to you (it may be faster or slower, depending on your case).

Thank you very much. But I find below choice, so I need to use the Application for Permanent Residence in Canada—Spouse or Common-Law Partner. but submit the application package to outside visa Office say Beijing China? Sorry maybe it's a stupid question.

If your spouse or partner lives with you in Canada, use the Application for Permanent Residence in Canada—Spouse or Common-Law Partner. Note: if a child of your spouse or partner is also living with you in Canada, they may be included on the application if they meet the definition of dependent child.

OR,
If your spouse, partner or dependent child lives outside Canada, use the Application to Sponsor a Member of the Family Class.

If we approve you as a sponsor, the CPC will send your family member’s application to a Canadian visa office to be processed.

She is PR, I am from China. Both of us currently live in Canada

As I see, processing time for Beijing is 9 months (although this can be misleading). In my opinion, you should check the tread for China: http://www.canadavisa.com/canada-immigration-discussion-board/-t80896.0.html

They will probably be able to advice you is it better to apply outland or inland, although according to the processing times I would think outland is better.

So, read the whole package for China (this is for outland application, the link includes all the forms, and the country specific guide-China): http://www.cic.gc.ca/english/information/applications/fc.asp

Then ask if you have any questions directly on the China thread, they may be able to help more.

Once more, you CAN apply outland although you are currently inside Canada. Outland just means it will be processed outside Canada, not that you have to be outside Canada. If you want to apply inland there is another set of forms.

Thanks for your patience, but CIC let me to choose whether we are currently living together in Canada please see below, if I use the choose " the partner or spouse lives with you in Canada, it will give me the page to apply the PR within Canada. Not sure If I need to use the form under "If your spouse, partner or dependent child lives outside Canada" so as to apply through the visa office in Beijing.

I completely understand why you are confused, but as I know even though you do live with your wife in Canada, you can still apply as if you don't. I think you should try and ask again at the China forum thread, I posted the link for you before.

Can someone else just confirm that he should use the package from the link I posted before?

To the original poster: your wife is a PR and you are living with her in Canada, right? Are you on a temporary resident visa? If so, you are really just visiting Canada, so you can apply outland as the previous poster said. You can use your wife's address in Canada as your residential address on the forms.

Hi Spaceexp.

I understand what you are saying.
But in practice, once the OUTLAND office figures out that the two of you are living INLAND, won't they take their time in processing the application?
Or will they process it just as fast as if you were actually living OUTLAND?

Does anyone have real-life times on this?
