Okay so I am freaking out. No word from Buffalo since I received my PER in February 2011. I'm on a post graduate work permit that expires this coming October and I don't know what my options are if my file is not finalized before then. I plan on submitting a CEC application end of June but still it would take at least 10 months to process. Postgraduate work permits are not renewable without an LMO. Would enrolling in a graduate certificate at some university and switching to study permit while waiting be an option? Please help :'(
I can understand your situation..... it is truly very stressful.
Mahek, for your PR application to remain valid you have to retain LEGAL status in Canada. You can (MUST) do that by applying for "Extension of stay" either for STUDENT or VISITOR if you do not get a Positive LMO, before the expiry of your current status.
As you may already know, that for Student Permit, you will have to show docs related to "Acceptance" at the Educational Institution; you also need a letter from the Inst indicating the type of course/ period etc. Based on the period of the course, you will be granted the Student visa. Also, be advised tht permit is not required for a course tht is 6m or less. You have to show financial status for the whole period you request for.
You can apply for a Visitor permit too. You can mention that you have a PR application in progress...which is considered a viable cause to remain in Canada. Again, financial status has to be mentioned. You will be in "IMPLIED STATUS" till your application for STUDENT or VISITOR is finalised. Implied status is a LEGAL status. You cannot work while you are on visitor status.
If this is not a possibility, then you can return to your homecountry to maintain a legal status, but your VO will not be transferred...it will remain Buffalo.
Hope this helps....
