I just confirmed with the bank that the BD had not yet been en-cashed :( :( :( Getting worried :( :( :( if my application is on my way back and lost track :mad: :mad: :mad: like couple of others here.

I still hope it wont be the case, and that CIO may take at least 20 days after the receipt of the application :-\ :-\ :-X :-X

Banker's draft will take longer to cash than credit card. Also as we have seen, some applications take longer than others for no explicable reason. Ours took 15 days from when they received it for encashment, when did CIC received your application?

Well based on the same timescales as us you might expect it to be cashed around 30th October. Of course this will vary from bank to bank and also how long your completeness check takes (seems that can vary quite a bit).

Certainly I wouldn't worry for a few weeks yet. If it gets to mid-November and still no encashment then I'd maybe give CIC a ring to find out what's going on.

Wayne, the link to the page below supports your view that "complete applications" go through (an initial) eligibility as well. However, if I understand it correctly (these are very confusing manuals), it looks like a final eligibility determination also takes place later, maybe a more stringent one, before they inform the applicant i.e. AOR. Below are segments:

"FSW applications received at the CIO on or after June 26, 2010

The second set of MIs applies to cases received at the CIO on or after June 26, 2010. The CIO will assess complete applications received on or after June 26, 2010, against the MIs to determine whether applicants are eligible for processing. Those determined to be eligible will be placed into processing. Applications that receive a negative determination of eligibility will not be processed and will receive a full refund."

Furthermore:

Final eligibility determination at the CIO

"The CIO will assess the applicant's submission as-is and make a final determination of eligibility. To be eligible for processing, the applicant must meet all the criteria described in the MIs. If the application is eligible for processing, the applicant will be informed and the entire application will be forwarded to the visa office requested."

Right, so what we are saying here is that there are 2 eligibility reviews at CIO?

So this (we think) would make the process:

1) CIO - Completeness check
2) CIO - Encashment of processing fees
3) CIO - 1st eligibility review. If ok then this counts towards the cap
4) CIO - 2nd eligibility review (more stringent), if this is ok then send AOR and submit to VO
5) VO - background checks
6) VO - medical requests
7) VO - passport requests
8) VO - final decision and issue visa

This would seem to indicate that from June 26th onwards they are placing more processing/work on CIO side and less work at the visa office.

2 eligibility reviews at CIO also might explain why CIC have been telling people that eligiblity reviews have been done, but nobody has received an AOR yet. It may be that these applications are in between 1st and 2nd eligibility reviews.

However, if this were the case I would expect very soon at least a few people to report if they failed the 1st eligibility review. Do you agree this would be the case?

If all this is true, then whereas we will see a longer process at CIC, it should mean things are faster once we eventually make it to the visa office.

I don't think anybody has received their applications back saying they have failed the eligibility review. Maybe they will start sending those applications back at the same time they start sending AORs...

That would be unfair?! what yah think? what if they rejected you because of your job description? you can revise it and send again the revised documents.

Alas very little of this process is actually fair. It's a giant game of musical chairs and some people are left without a chair when the music stops.

All you can do is your best and then cross your fingers for a little luck! ;)

I would think that is the exact reason why they would not send it back immediately, because some people who were not qualified under their NOC would make quick changes to qualify and send their applications back... further clogging up the system.

No one really knows what is going on, and I agree, a fair system has certainly not been found...

If you read Minister Jason Kenny's speech on June 26, 2010 it says:

"For example, in the category of university instructors, we received several thousand applications in that occupation – just basically people with university degrees who may never have taught as university professors and who have now applied in that category because that’s the way to get a positive decision."

The minister calls what has taken place above "abuse" of their immigration system. I think if those applications were sent back quickly, those same applicants would have changed their applications to conform with what CIO wanted, and would send it back...

I don't believe that is what CIO wants and for that reason I believe they hold on to the applications that fail eligibility for a while before responding... this is my opinion only.

If some one is calling now and the application is found entered as per records available in CIC please do check this 33 weeks news.

May be we can get a response for less then 33 weeks or more then that. worth knowing....
