Application under NOC 0213 - DENIED?

Well, I submitted my application on January 5, 2010 and it was just returned (today) for not matching the skilled worker category.

I worked for 2.5 years with the job title "IT Manager". My duties included managing IT operations, hiring, budgets, provisioning, process, policy and security.

The exact wording of the letter I received is:


You have indicated that you have work experience in an occupation with the following NOC code: 0213, IT Manager, IT Specialist. Although this NOC code corresponds to the occupations specified in the instructions identified by the Minister of Citizenship, Immigration and Multiculturalism and published in the Canada Gazette on 28 November 2008, the main duties that you have listed do not indicate that you performed a substantial number of the main duties of the occupation as set out in the occupational description of the NOC, including all of the essential duties.
I don't have the exact wording of the application I submitted, but I'll try to dig that up when I get home from this business trip...


I didn't really consider that it would even be a risk... The fact that the actual job I performed was an exact match for the required job description, I just didn't spend that much time thinking about how to write down the job duties... Oye!!! I don't recall seeing a "essential duties" list anywhere in the documentation I found when going through the submission.

The other issue I can see is that I also had a previous job of 3 years listed with the job description of "IT specialist (Supervisor)" also under the 0213 category, where I was a supervisor for a section of the IT staff and one of the facilities within the company. I figured the supervisory role may also dictate the 0213 category, but I didn't think it was a big deal because I already listed above it, 2+ years of work with the title of "IT Manager".


Is there any recourse in this issue? I'm not sure if I'm allowed to re-submit the application in order to clarify my job duties, because they ARE exactly in line with the job description see listed for category 0213... Am I totally out of luck? I'd already gone out home shopping in Calgary - I'm starting to wonder if that was premature?

I make a six figure income in the US, I have a clean background, I spend 8-10 weeks per year in Calgary and Vancouver and a number of my close friends live in Calgary. My step-dad, and my brother and sister are all Canadian citizens, but none of those things increase my qualification for immigration. It seems to come down to the semantics of what "supervising staff" is and whether that is actually "management"... perhaps...

Anyone have any suggestions?

The only way you could convince the immigration officer at Sydney is by detailing your duties in the economic class form. As a practice, many of us attach an additional sheet to the form with the title and job responsibilities that are relevant to NOC code. Im not sure you did the same too.
IO at Sydney does the assessment based on the information we submit and all other factors like adaptability, education, background are done at Visa office - second stage.
I think you should re apply with more information, produce more evidence this time , like a reference letter. Good luck

I wasn't sure if I was allowed to re-submit. I don't want to risk my future status, or get myself flagged somewhere, by mixing up some bureaucratic process issue like submitting the wrong application or re-submitting an application where it wasn't allowed.

I'm amazed, I did a ton of research on the CIC website before submitting. I guess I erred by assuming that their information was most complete and not trusting outside sources, because I didn't see, anywhere in their information, a recommendation to list more substantial details of the job than simply what would fit in the brief form field.

Other than the 7-8 week processing time to Sydney and the postage, I guess I haven't lost much in the process? I hope someone else can confirm this. I would hate to end up on the wrong side of another paperwork snafu.

I didn't see anywhere in the form to list family members who are Canadians who do not live in Canada. My brother, sister and step-father are all Canadian citizens. The siblings are in school in the US and my step-father is on a green card right now, so they don't qualify under the "family living in Canada". All of my step-family are Canadians living in Canada, but I don't think they will accept that as family, even if they've "actually" been my family since I was around 5 years old.

Anyway, Thanks for any insight you can provide.

I think I figured out the problem.

I listed a job as a "supervisor" under 0213.

I think they're reacting to this listing being mis-categorized. I just read the description and it specifies:

Classified elsewhere

* Computer and information systems supervisors (in 217 Computer and Information Systems Professionals )
Since I mis-categorized the supervisor position, it probably affected their decision.

I will also obtain a letter of reference from my boss outlining the job duties as closely as possible following the template given by the CIC requirements.

Will this likely suffice?

I got my application approved so hope u will also get approved.
BTW u are also elgigible to get all 21 points and not just 2+ yrs for ur IT manager.

Would anyone be able to answer the question:

when do I need to show proof of $10,000?

I have a lot of non-liquid assets and a number of things like several rental properties and a yacht that always needs expensive fixing. Depending on the time of the month, my bank can be $15,000 or $5,000. It has varied between $24,000 (or so) and $500 over the course of the last year, depending if certain rental payments are late or I had to fix a leaky roof on a rental house that month... In all, I make a good profit on the rentals, but I still work a regular job too. I also have two cars that are paid off and I plan to import at least one of them if possible, though I could sell them if there is some issue with insufficient funds.

What exactly is needed or acceptible as proof of funds? A single bank statement from any time this year reflecting a $10,000 balance? Proof that I have consistently and always over $10,000 during an extended period of time (which I haven't)? Proof of $10,000 per month income? Proof of $10,000 worth of US-based credit? :p How about proof of $50,000 in positive net worth of non-liquid assets?

Edit: I guess it's $11,086 now. Inflation and all...

Is that the last 3 months before arriving? Before submitting the initial application or before the final submission to the visa office?

I'll need to be careful with my account so that it doesn't fluctuate too much during that period... I think I only have $5,000 in the account right now, but on April 1 it will be around $15,000. By April 10, it will be $9,000. Maybe I should sell my work truck...

Just collect all data and re-submit your application to CIO and hope this time it is accepted.
Think about the rest of docs at a later stage

Please Forumites and NOC 0213Mates, is this enough for job reference from a boss? He sent this to me as he lives at another city right now while I still administer and run the workplace and answer to him. I told him I will have u guys look at this and let him know what he can edit before printing on our office letterhead.Some has said he should say more on the Sept 2009-March 2010 duties. I really wanna go to Canada even though I have an eye at Australia.

I filed Nov 20th 2009 to Nova Scotia but got my application returned to me in Nigeria in January 2010. I forget to state my qualifying category (Computer & Information System Managers) and not including the page 2 of IMM0008 (My family members) I thought since only me is going, that won't be necessary.

Am preparing my paperwork in readiness to face my local embassy (Accra) after I get my AOR and other stuff, so that I won't lack time. I did my IELTS last Feb but the band score is not okay.I will retake in Lagos,Nigeria on May 8th 2010, do my police report there too. I live in Jos,plateau State,Nigeria.

Job Reference in the making

Ferdinand joined the company, Kris St. Chuks Limited, an internet service provider and a computer hardware sales company, as a technical assistant in October 2001.

Dear Irshad2005,

I have a very similar case in terms of technical background. What interests me is that you said in your reply that Calgary4Me can claim all 21 points for 2+ years of experience as a IT Manager. I was promoted to the post of Mnagaer and worked as Manager for only 3 years after working for 5 years in a junior role. How can I convince the visa officer in this case to claim 21 points as my managerial/supervisory experience is only 3 years??
