Hi guys!

So me and my family sent in the first part of the family sponsorship application about a month ago. I'm the canadian citizens cousins daughter, so we are in the "other family class". The application was recieved and I have been able to log onto the check status online site. It still only says "application received", but about two weeks ago our application was sent back to my family in Canada. It says nowhere if we did anything wrong or if they need other documents, it was just plain sent back to us. What do we do with this? I can't find any phone numbers nor email adresses that we can contact them with and ask. Is it normal that they send the application back?

What do you mean you "sent in the first part"? A complete application has two parts (sponsor and applicant), but they both must be sent in together. If you did not, then it was sent back because it was incomplete. If it was a complete application, did you send it to the correct place?

Yes I suppose my question amounts to about the same. What exactly do you mean by "other family class"?

I can't see any way that a 'cousins daughter' could end up being sponsored in any family class by a Canadian citizen.

Hi Viebs,

A person can be sponsored under the "other family class" only if the following conditions are satisfied:

You are the daughter of your supposed sponsor's cousin.....so, in general most people would refer to their cousin's daughter as their niece (and technically nieces can be sponsored if they are orphaned, under 18, and unmarried). However for immigration purposes, I am not 100% sure whether you are technically your sponsor's niece...? Usually a niece is the daughter of someone's brother or sister, and I'm not sure whether the CIC still qualifies you as your supposed sponsor's niece.

Even if you qualified as the sponsor's niece, you'd still have to pass the other criteria....i.e.:

- are you orphaned?
- under 18?
- unmarried?

Basically, to be able to sponsor you, your Canadian cousin has to have NO RELATIVES THAT ARE CANADIAN OR CANADIAN PR AND NO IMMEDIATE FAMILY ANYWHERE ELSE IN THE WORLD. Based on the unlikeliness of that, as the cousin once removed of the sponsor, you are not actually eligible to be sponsored in the Family Class. I am guessing that's why the application has been returned to you. You will need to try to apply through a different class of visa.

I have my entire family tree from England that is in the other form, so I suppose different countries define it differently.

As for "laying of the OP", justify the reason for stating that. I did not give a lecture, I stated the probable reason for her application being returned and why....

The OP is not eligible to be sponsored as a member of the Family Class. Even if some people would refer to her as a niece, she is not a niece officially. In any case, you could only sponsor a niece under very unusual circumstances (already mentioned in an above post). You can only sponsor a cousin under very unusual circumstances as well, and though many people refer to any type of cousin as a cousin, for immigration it would mean only the son or daughter of your aunt or uncle.

However, some of the provinces have Provincial Nominee programs (which come and go, and vary year by year). The OP's relationship may qualify under one of these.

It seems that regardless of the exact relationship, there is no chance that this application would succeed.
So, the return of the paperwork would save them wasted fees.

did you get approval from cic canada if not maybe you are not eligible because your cousin have some relative in canada you can only be sponsor if your cousin do not have a relative spouse or children living in canada

So, for the OP.... the reason you application has been returned is likely one of the following:

1. you are not eligible for immigration in the Family Class, OR
2. the application was not complete (all required forms for both sponsor and applicant) OR
3. the application was sent to the wrong place, OR
4. some other reason that cannot be determined from the information provided....

The #1 above is most likely the reason. Hope you can determine from the responses why this happened.
