Here we go ... I am filling out the application forms for Sponsoring Common Law Partner Outside of Canada

Questions: Do I need to fill out the Statutory Declaration of Common Law Union (IMM 5409) if I do not have a co-signer on my application? Or is it meant to be filled out for myself and the partner I am sponsoring?

Question: Sponsorship Evaluation Form ... the question where it asks you to number how many people you have been undertaking in effect and not in effect ... I haven't sponsored anyone and I don't have kids or anything, so do I just keep the '1' for myself or do I have to put my partner who I want to sponsor in this area?

Question: Sponsor Questionaire ... when it asks if you are living with someone ... does that mean at that moment? (I am living in the UK), or does it mean who you will be living with when you get back to Canada?

I would appreciate it soooo much if anyone can help! Xx

Since there are no co-sponsors involved in a spousal/common-law application, then technically the stat declaration form is not required.

HOWEVER know that some common-law applicants have been asked by their visa office to send in this stat declaration form during their processing. Nobody knows if the visa officer is asking in error since it's not a required doc, or if they want it to show extra proof of common-law status. If they ask, you need to simply comply and send it. But these cases are not that common. If you don't send it with app it will be fine (as they can be a hassle to get done), and worst case you could be asked for it sometime during processing.

You (4. Yourself) and your common-law partner (5. Current undertaking) = 2.

It's asking who are you living with at the time you submit the application (so today), not at some future date.

Hey Laura, I'm reading these posts and I think we are in the same boat! I am from Canada living in the uk with my English boyfriend. We are currently working on the common law visa, I was wondering if maybe we could help each other out :) if you would like to email me or vice versa please let me know!
