Hi ,
Here is my situation:
I am currently in US on H1B for past 3.5 years and applying for FSW category 1.

After I file my PR application in Buffalo, NY Office, if I have to go to my home country after 6 months(before the completion of processing of the application), which visa office will continue to process my application?

FYI, even after I move to my home country, I will continue to have a valid H1B status in US for next 2.5 years.
Is it Buffalo Visa Office,NY or home country visa office?

If the application gets processed successfully, where will need to go to collect my PR visa? my home country or Bufallo, NY?

Please do reply. I am in a confused situation.

Thanks for the reply.

In case I don't have a valid visa at the time of interview/collection of my PR Visa? is there any work around? or should I request for a file transfer? Please let me know.

You application will be processed in Buffalo.

You will still collect your visa in Buffalo.

This is because, if you want to transfer , then you do not have any good reason why, you would like to transfer yur application to your local visa office.


Yes, if you visa expires , when you have not finished your process, then you have a good reason to transfer your file.

If you know the stage where your application is then , you can give it a try to transfer it and hear what they will say.

For example if they are doing your assessment then you suddenly ask them to transfer your file, then you have to start afresh from the new visa office.

So it is left for you to study the situation very well and see what is happening. Then you can make a decision.

Hope this explanation helps you to make a decision.

Is my understanding correct?

if i were you i will also check the time lines for both visa offices and see which one is faster.

you do not have to come for medical. you can do your medical in indian but you have to come for your pr visa because you can not post your passport from indian.

Thanks for your replies.

However, even after so many years of immigration, why there is no clarity on how to get the PR Visa from Bufallo, NY or some other office when you are outside the country where you submitted your application for initial processing.

It looks like a very big hurdle.

Is there any reference on the CIC site to clarify such scenarios?

Experts, any guidelines for such cases?

I am sure that there are 1000s out there sailing in the same boat.
