According to a new evaluation, there is a continued need for Citizenship and Immigration Canada (CIC) to manage the intake and processing of immigration applications in a timely and efficient manner, and ministerial instructions (MI) are a flexible and responsive tool to do so.

"“The evaluation confirms that it was right and necessary to take measures to manage the sheer volume of applications we receive,”" said Citizenship, Immigration and Multiculturalism Minister Jason Kenney.

In 2008, the Government of Canada introduced changes to the Immigration and Refugee Protection Act through Bill C-50 (the Budget Implementation Act) to tackle the backlog of federal skilled worker (FSW) applications. At the time, more than 640,000 people were waiting to be processed in the FSW category. In order to increase labour market responsiveness and overall efficiency, the Minister was authorized under Bill C-50 to issue special instructions to immigration officers to limit the number of applications processed, accelerate some applications or groups of applications, and return some applications without processing them to a final decision.

According to the evaluation, MIs have helped to reduce the overall FSW backlog. Without MI-1, the FSW backlog would have been at least 850,000 people by 2012. Today, the total number of people awaiting a decision in the FSW program is under 470,000. Furthermore, processing times for newest FSW applicants have dropped considerably – from five years in 2008 to 6–12 months.

"“Our government’s priority is jobs and economic growth. We are committed to the creation of a fast, nimble and flexible immigration system that can help our economy grow,”" said Minister Kenney.

I know all our champion members like Jaggy, spartan, rawlin, and babu mann all already know this but i am just giving more info for newbies......

Just to elaborate on the proposed amendments...

a) Previously the law says (at section 11) that an officer “shall” issue a visa if the applicant meets the requirements of the Act. This is changed in the bill to say an officer “may” issue a visa if the applicant meets the requirements of the Act.

b) Previously the law says (at section 25) that the Minister “shall” examine an application for humanitarian and compassionate consideration (H&C). This is changed in the bill to “may” examine the application if the applicant is outside Canada.

c) The bill gives the power to the Minister to issue instructions for the processing of applications from economic immigrants and H&C applicants outside Canada. The instructions could establish categories of applications to be processed, determine the order in which the applications should be processed, fix a limit on the number to be processed, and provide rules for repeat applications.

d) The bill empowers the government to retain, return or otherwise dispose of applications that, following the instructions, are not processed. This only applies to applications subject to instructions, ie. economic immigrants and H&C applicants outside Canada.

The amendments give too much arbitrary power to the Minister to make up the rules as he goes along.

With these amendments, the Minister can introduce “instructions”, without Parliamentary oversight or mandatory consultations. The instructions will make important changes to which immigrants are processed and accepted. Having the rules for who gets in made and changed by ministerial fiat creates uncertainty, lacks transparency and makes the immigration selection process vulnerable to inappropriate political pressures.

Applicants’ legal right eliminated

The amendments eliminate the right to permanent residence for applicants who meet the requirements of the Act.

The proposed amendment in IRPA s. 11 from “the visa shall be issued” to “the visa may be issued” dramatically reduces the rights of applicants. The current wording allows an applicant to seek the intervention of the courts if Citizenship and Immigration Canada is not meeting its responsibility to process the application and issue a visa, if the applicant meets the requirements of the law. Under proposed amendment, the applicant will no longer have the same legal basis to demand that the processing be finalized in a timely manner. This applies to all applicants, whether in Family Class, Economic Class or Refugee Class.

Overseas humanitarian and compassionate applications

The amendments eliminate the right to have an overseas application for humanitarian and compassionate (H&C) consideration examined. Instead, the law will permit such applications to be returned unexamined or simply shredded.

Previously, H&C is the only recourse for many people with compelling reasons for seeking permanent residence in Canada. This includes cases involving family reunification for children (e.g. families separated by the “excluded family member” rule, Regulation 117(9)(d), and refugee children in Canada whose parents are overseas).

The government has suggested that they do not intend to use the shredding option for family-related H&C applications. However, the amendments permit the shredding of these applications, so this remains a possibility, under this or a future government.

Hello folks,

Newbie here. Been following the thread for a few weeks. Good job, keep it up.

Have a question. Wondering if the senior folks could throw some light - My application was recieved by CIC NS office on March 22 and acknowdleged on March 30 via e Mail stating it would be sent to the VO office(Mine is ND). Ever since this mail, no further communication from NDVO about the file being recieved by them at NDVO. Is it normal for such delay?

It's less than a week for MI5... Fingers crossed...

Kenny is trying to get many changes from last three years & presenting the bill but not getting through...

now a days NDVO is a bit slow

What was the email about, Is it also mention the text you file has received a positive final determination...Like that then its PER then they forward it to VISA office ..NDVO has been sending Acceptance of receipt within 20-60 days...Might be the other way around they gonna issue MR directly via not going through AOR...Whats your ecas flasing?
