Asbereth, I was really mad when I heard what that Visa agent did to you when you were doing landing. Is there any way you can complain or send a letter explaining what happen to you? What that agent did was completely wrong!! She had not right to tell you TA/RA is not a job, and make you go through another "mini" process there. I'm sure this was only bad luck with a bad agent. I was pretty upset and wanted to go tell that agent a few things :)
Hi rgb--Congrats!! for ur PPR, I have a question, how long it took for u to finish ur masters, I am afraid i have finished in 1 yr and 10 months, finished 5 semester. Although my CAIPS note shows they gave me 5 points for canadian degree but i have bad feeling VO might play some extraordinary game :mad:. Another question, since you already got the PPR therefore taking this oppertunity to ask u one more question, do u mind to write the first few notes of (at the end) ur GCMS. Your co-operation is greatly appreciated.

Subsection 75(2) of the Immigration and Refugee Protection Regulations states that a foreign national is a skilled worker if:
a) within ten years preceding the date of their application for a permanent resident visa, they have at least one year of continuous full-time employment (37.5 hours/week) experience, or the equivalent in continuous part-time employment in one or more occupations, other than a restricted occupation, that are listed in Skill Type 0 Management Occupations or Skill Levels A or B of the National Occupational Classification matrix;
b) during that period of employment they performed the actions described in the lead statement for the occupation as set out in the occupational descriptions of the National Occupational Classification; and
c) during that period of employment they performed a substantial number of the main duties of the occupation as set out in the occupational descriptions of the National Occupational Classification, including all of the essential duties.

I am not satisfied that you meet these requirements. Your letters of reference from the University of New Brunswick did not list job duties or responsibilities that match the actions described in the lead statement described in the NOC code you selected – NOC 4012. As such, you failed to demonstrate that your periods of work experience met the requirements listed above.

Subsection 75(3) states that if a foreign national fails to meet these requirements, the application shall be refused and no further assessment is required. I am not satisfied that you meet these requirements.

Subsection 11(1) of the Act states that a foreign national must, before entering Canada, apply to an officer for a visa or for any other document required by the regulations. The visa or document shall be issued if, following an examination, the officer is satisfied that the foreign national is not inadmissible and meets the requirements of this Act. Subsection 2(2) specifies that unless otherwise indicated, references in the Act to “this Act” include regulations made under it.

Following an examination of your application, I am not satisfied that you meet the requirements of the Act and the regulations for the reasons explained above. I am therefore refusing your application.

rgb, it was only my bad luck :) Most people who landed actually had a nice and pleasant experience, and I'm not sure why she felt she needed to grind me on issues such as bank statements and TA/RA 'employment', but it was up to CIC to determine whether my work experience was valid, not CBSA :) Since you just got your GCMS notes, can you share what exactly was going on during 'Decision Made' date? I know you don't care about this anymore, but a lot of people would be curious :) And good luck with your landing and I hope you get back your passport really soon :D

kaziahmmed, do you have to rely on these five points to get above 67 points? I heard somewhere that an academic year is equivalent to 8 calendar months, but I could be wrong. I'll try to dig more about it (but I'm currently at a workshop, and Internet connection was super bad here :( ).

Anyway, I just got my new GCMS notes this morning (current up to 24 of April, and by a stroke of luck the Internet was working at that moment before crapping out again).

I passed medical on April 12, and this was also the day my application was granted (it looks like my background check was concluded before even my medical was passed, maybe that's because I haven't been out of Canada in almost 4 years?). I got 'decision made' on the 15th, and PPR on the 16th, so there was indeed some delay post-approval before my application got into latter stage.

On second to the latest notes (The last note (April 16) was pertaining to passport request), dated April 12, FA01772 wrote

"FOSS checked, documents checked and PA meets all requirements. RFV pending RPRF payment"

Based on what I've read so far, RFV is short for "ready for visa", and it looks like that, as of April 24, my RPRF was still 'outstanding' (not attached yet to my file), despite the fact that I paid off this fee on April 16! That's probably why it took them a long time to stamp my passport.

So folks, if you already got your medical, immediately pay off your RPRF (or if you somehow know that you have already passed eligibility). This fee is refundable if (God forbid) you got rejected, so there is no risk. It seems to take quite a while for the fee payment to get attached to your file.

One example, TyrusX just got his tracker activated yesterday night (meaning his passport is on the way), and he paid off his fee long before he sent his passport. It only took him 20 days to get it back, whereas it took me 4 weeks :)

Could you share your RA letter with us?

According to my experience if RA letter generally does have all of the following things it will be accepted otherwise rejected:

1) ASSIST PROFESSOR IN RESEARCH ACTIVITIES
2) CONDUCT LITERATURE.....
3) CONDUCT LABORATORY EXPERIMENT
4) COMPILE RESEARCH
5) PRESENTATION
6) JOURNAL ARTICLE AND CONFERENCE PAPER

you have to write your duties such that include ALL of the EXACT mentioned KEY WORDS. ASSIST, CONDUCT, COMPILE, JOURNAL, PRESENTATION, CONFERENCE are very very important works. YOU MUST HAVE THAT.

Hi, S_Govind, N_O, a_nashed, Stuck In Quebec, asbereth and hooman2012, thanks for all your concerns and recommendations.

I didn't order any GCMS so I don't know which VO was assigned to me. Also I didn't update any of my working experience as I have always been a RA/TA.

The thing is, I have never been working (in industry or academy) before or got married, so CIC could find whatever kind of reason to reject me if they would like to.

It's not worth playing the expensive and time consuming game with them any more. What's more important is to think about how to graduate asap and find a job afterwards (i assume you still want to stay in Canada by that time). Once you have a Canadian degree and working experience, it surely will be much easier to apply for PR through CEC stream.

I think the most important thing for NOC 4012 is that your letter MUST embody that you are "assisting"or "helping: supervor with some research otherwise even if you write the full description, it will not work. Because conducting experiment, compiling research, doing presentation....can also be done by other kinds of resarchers like Postdocs, emphasizing "assist" is the only way to distinguish that you are a Research assistant.

This is simply ridiculous. They are just destroying our career at the most crucial time of our life. Destructing me severely from my work.
