Since i last wrote, we were waiting for the "blue book" from the embassy in Mexico City so that we could move forward with our appeal of an ARC decline.

We received the "Record" (otherwise known as the blue book) after 4 months. shortly after i also received a letter that said our case had been screened for an ADR conference (a mediation conference between the Minister's representative who are in charge of granting ARC's, and myself). It is a less formal way to work out the issue at hand. It is confidential. No risk.

And if the Minister agrees to overturning the decline and granting an ARC, then it is a matter of signing an agreement and getting the appeal board to acknowledge it and sending the file back to Mexico to finish processing the Permanent Residence Visa with ARC granted.

If the Minister disagrees to an agreement during the conference, then there is still a chance to attend a FULL Appeal Hearing to plead your case.

Our Original application date was roughly around Nov 2008. On week of Nov 1 2010, i attended an ADR conference (11 months after the decline of the ARC in the first place).
The Minister agreed to overturn the decision and grant an ARC. I received a copy of the fully executed agreement including appeal board approval today in the mail. They are sending our file back to Mexico City to finish processing and obtain updated medical/criminal etc and he should be home in 6 months or less (hopefully less)!!! We are so excited. Perserverence paid off!!! :) Best of luck to all others in this situation.

P.S. My submission for the ADR conference was almost 30 pages.

Also, if you haven't read my original previous postings over the last year, we were told by immigration, 2 members of parliament and the appeal board that we had no right of appeal and had no hope. That was in January. If i had listened to any of them, my husband and i would never be together. You have to believe in what is in your heart. I knew they were wrong. What they said didn't make sense, and i didnt' give up. YOU CAN NEVER GIVE UP!!! You have to fight for what you want in life. And here we are, he is coming home.
