I know a guy who was rejected and applied for H & C and has been without a status until now. He has been renewing his Temporary resident permits (TRP) for almost 7 years just to allow him to stay in Canada.

The first rejection from IRB based on your case is a reason for CIC to delay the process of your H & C application as they will see you as someone who is not credible.

Was his H&C approved 1st stage or he's still waiting for a decision? Plus the processing time is 34 months, so he really need to check what's happening.

the last negative decision was in 2015 Nov , basically it has been more than 12 months.

Yes but you are still waiting for a new hearing date which means your case is not done at the IRB and therefore you are eligible yet.

not he's not been approved for Stage 1 yet as it seems they were not satisfied with some elements of his H&C..so yeah it's been a long time
