Almost 3 Years as a Temporay Worker Under Live-In Caregiver, PLS. ADVISE!

Hi,

I've been working under LCP for almost three years with the same eployer but I havent applied for Permanent Residency yet. My employer didnt file for my TAX since then. Now, I couldnt pass my application for the mere fact that I lack that document.

My employer gave me a three-year contract which will expire in June 2011. I planned to visit my family in my country but i am afraid that I would face problems in re-entering Canada. My Visa had expired in 2010 and I need to apply again.

Owing to that, I applied an extension of work permit online just to apply for a new visa. With the application, I just sent a scanned copy of my passport which was the only thing that was asked. Now, I am afraid that it will be rejected because I read in my searches that the copy of contract is needed too.

Please, advise me what to do. I am so depressed, confused and tired of thinking.

How long ago did you send your WP application? You can send copies of your contract, letter from your employer that s/he is renewing your services, and marked pages of your passport (when you entered Canada), and a cover letter explaining you failed to attach the documents with your online app.

How did you get paid all these months? Cash?????

I just sent the online application almost two weeks ago. I was confident that the scanned copy of my passport was sufficient because I wasnt asked for anything when I did that online. Nevertheless, i can send a copy of those if I really need to.

And yes, I get paid cash every other week. I have no payslip whatsoever.

It is still not too late for your employer to the tax due for 2010. Ask for your T4. S/he should give you that. If s/he has been withholding and deducting CPP/EI/Tax, and has not been remitting the same to the government then s/he is shortchanging you and the government. I don't know what to do in this case. Maybe members in the know can give you some advice. As to your work permit application online, there is a checklist of documents that need to be submitted. Send those that are applicable to you. Together with a copy of the checklist.

I am just wondering why I wasnt asked for those documents--pertaining to submission of e-application--if they're prerequisites in the first place?

This is a long journey...not easy..SO TOUGH!

By law, she should give you your T4 this February. then find another employer while you still can finish the Live in Caregiver program, that is if you want to become a permanent resident of Canada. Not so tough. Know your rights!!!!

If not, you can report your employer to LIVE-IN CG HOTLINE, if you were told before that s/he is paying your taxes.

She said she's working on my T4...and I heard that years ago. I dont want to believe her this time, but she seems sincere.

After February, if the T4 is not yet given, what's the best step i need to do?

Then how come you still take her word for it, why waste your time and possibly your future of becoming of PR with a not so honest employer.

Think about it....

how come you never ask her about your T4. which province are you working? its against the law not to file the tax. thats tax evasion. she could get fine or even imprisonment.

I just read my inbox today. I was trying to respond but I can't send to you my reply because your inbox is already full. Anyway, about your online application for a wp extension, I'm afraid you will encounter the same problem with mine. I didn't submit also my emp contract because they didn't ask for it in the documents section. I only submitted scanned copies of my passport pages and the result was they refused my application. So I applied again and paid another 150 bucks. Since you have just submitted your application, it's helpful then to email the immigration so they can put a space in the documents where you can upload your contract or better yet fax it to them. Act now I'm sure they didn't process it yet!
