Hi, can you give us some guidance then please....did you appeal or re-apply? It seems scary to even go the road of appeal if they are saying if you are denied you will never be allowed to sponsor your spouse...Jesus Christ how is this even possible??

We've been told appeal is 2 - 2.5 years....did you do ADR within the 6 month period? How does it get determined to ADR? Re-application we are told is 1 year. Did you hire lawyers....

Please share your story. In all this turmoil I am trying to determine our best course of action, any help is greatly appreciated.

could anyone who went through appeal and their visa was rejected because the officer though their marriage wasn't "genuine"
what type of documents did you submit for the appeal as evidence? my date to submit is near.

Every body has the same reason, dont worry make agood file of proofs and be patient because its a long process
 
Unfortunately new to this forum: Outland Spousal Sponsorship / Sponsor: Canada / Applicant: Ghanian
Applied July 2019 / Refusal letter received yesterday: Feb. 2020 (after 7 months).
Reading that if you appeal and is denied means you can never sponsor your spouse - seriously? So why would anyone appeal?
Is re-applying the way to go?
Refused based on personal bias of immigration officer who was jealous and made decision as spouse walked in the door (didn't look at over 1500 pages of evidence presented to her at interview or 500 pages of communication). He answered all her questions correctly, but she didn't base her decision on fact, this was personal.
Questioned: only 1 member at the wedding - so what? we wanted small ceremony at court with our friends and celebrated with dinner and drinks with the rest of the family (who were minding small children or working) and 1 member represents the entire family anyway - people elope and have no members of family at wedding. We celebrated with family in Ghana after and had planned celebration with friends and family in Canada once he arrived.
Questioned: you are only with her to get to Canada (as we are age gap relationship) - he doesn't care about Canada, but I have better living and he is going to come where I live; he wouldn't be with me for 4 years if he only cared about getting to Canada, faster ways to do that.
Questioned: you know all the answers to the questions I am giving you - of course, that's our job to study and review the questions and answers and we've been together for over 4 years of talking everyday...why would we not know about each other.

Looking for some advice and input....right now feeling really raw, hurt and in disbelieve over this entire process. We are real, genuine, yet people that were obviously fake got in no problem on the same day - this seemed very personal and not based on evidence or fact.

We had applied through immigration lawyers, I also work with the law...I think that female officer was jealous.
None of it Makes sense, my spouse also had his interview on January 20th in Accra it was even his Bday. When I recieved the email of refusal I cried for like 2 days. I was distraught, I have been praying for support here with our almost 3 year old daughter. We will overcome.

Best course may be aking for a gCMS note and read and understand the notes that will tell you why they deny visa

you have to-provide valid proof to overcome their objections/ suspicion

and put a new application

if you appral and lost still you can re apply

I was told if we appeal I would never be allowed to sponsor him ever.
Reapply problem is it still goes back to Accra - corrupt people
Yes, we will get notes and see what fake bullshit she put down for objection
People with no time together all from a certain country be getting in in under 20 minutes
we been together for 4 years and we are not genuine - it is laughable

Anyone have referral for a good appeal lawyer in Toronto (with reasonable rates or payment plan) that won your appeal?
 
We won our appeal in Montreal yesterday (1 year, 1 month and 10 days after refusal). We told them what we thought about the lying visa officer(s) and the Minister's Counsel didn't say one thing in defense of them. The Minister's Counsel said she had no problem allowing the appeal after talking to my husband and the judge said she agreed. Good luck to everyone still fighting!!!
I am in same situation with an officer that refused us based on her personal bias - jealousy. I am starting the appeal process...barely hanging on for me and my husband...spent so much time and money on a lawyer here in Canada to submit our application, then couriered documents to husband overseas for his interview which cost us a lot and then he also printed out additional documents....Should I get all that back now for the appeal?

Can someone give me insight into what is involved with appeal case - yes, I need hand-holding...I am still shell shocked over everything.
