I am so sorry TrueLOve. I wasn't expecting this. do you know what their concerns were? What were the red flags? I wonder if you re-apply, would that be better? You can present your case better the second time. Perhaps consult with someone before applying for an appeal. All the best.

Is anyone sure about the police clearance certificate validity...... is tht for 3 months or 6 months or one year ..n i want to know i have been to usa and have the last criminal record clearance in 2012 after that i didnt go to usa ....do i need to get the updated one or tht wd work as i didnt go to usa again...n can anyone tell me the processing from tht we won the ADR 18 nov 2015 n got the letter of confirmation on 26 nov ..still no replies ....can anyone tell about how we gonna be informed by email or post....n do we need to send the the approval letter of ADR to ottawa n if yes ..can you please tell me where to send n whom to address the letter...

Hey preetsarab18.... First congrats on winning your appeal...we got our decision letter on November 12, 2015 so you is not far from me at all.. here in Jamaica our police record is valid for 1 year but I think it different with other countries but I think cic let it valid for 1 yr but I hear other ppl say different things. the best thing to do is call cic after the holidays and ask them how long it valid for... 5-8 months for a person to get there visa after an appeal is won and it take about 2-3 month to hear from cpc-ottawa on requesting police record. medical and update forms. Just email them at cpc-ctd-ottawa@cic.gc.ca........ If you spend more than 6 months in the states then you will need an fbi record for sure but if not then you will be ok....I hope this help and we can keep intouch since our time line is so very close with each other....I hope to hear from you very soon........Maddants

Hi all hope everyone's Christmas was good. I have a question and hope someone can help. My lawyer sent for a request for ADR iAd said yes we can have a ADR as long as cbsa agrees. iAd said cbsa needs to respond ASAP but before dec 4th it is now almost a month late and cbsa has still not said weather or not we can have ADR. What's next? Does cbsa not have some sort of protocol to follow? Do they face any repercussions if they do not meet a deadline? This is so annoying! If we did not meet a deadline as we were supposed to I'm sure things would not be good for us. Someone please let me know. Thanks so much
 
I saw someone on here send proof to IAD before they ask. Who was that? You send your proof and change their minds about not giving you an ADR?
Why I ask is that our lawyer is not asking for ADR as he believes they are not successful most times. He also says it will be two years. We are into this appeal about 6 mos.
I have been back two times now since we June.

MaryL, how are you doing. I think your lawyer is telling you the wrong thing about ADR hearing. Been on this forum i see alot of ppl get adr hearing and win there appeal cases.. You is the one paying your money to the lawyer so you should be able to tell him or she what you want to be done. It better you try and get an ADR hearing which the time can be shorter than a full hearing and if you get granted for the ADR and lose you can still go for the full hearing. The more option you have the better.
 
Yes of course I have thought of that. The lawyer wanting to make more money or truly just helping us. I have had the file since early Nov. Trying to make best decision for our case.

Hi MaryL

Did the initial agreement with the lawyer include ADR and full hearing? Or were they separate fees?
I was lucky in that my agreement included both.

I think it is always a good idea to go for the ADR. Even if you do not win, it will give you insights into what the Minister's Counsel is concerned about and help you prepare for the full court.
 
Need some help my application was refused dec 16 I received refusal letter on 23rd but my sponsor have not received yet in Canada it's been 2 week I am worried that we have 30 days some one told me to apeal or its 30 days from the day sponsor receive appeal documents ?should I email London that we have not received our apeal documents ?
