Hello, does anyone have got the ADR if sponsorship was rejected on ground of 4a (Marriage for convenience)

Reply much appreciated, This is site is blessing coz, no matter what lawyer we took they are just taking our money and say thank or sorry.

as far as I know, when they say MOC....count on going to full hearing. Where will your case be heard ? Wait times in Toronto are horrible

What is the next step after winning the appeal. Do we need to fill out all forms again

they will contact you. You will need to update some of the forms and re do medical and police. where was your case heard and how long did it take ?

It was heard at Vancouver on feb 20, 2013. I appealed on May 2, 2012. Still awaiting final decision on appeal. Very complex case, no lawyer

no lawyer ? you are brave !!! How did it go ? Did they judge say anything at the end ? You will get the written decision soon I received mine 3 weeks after the Hearing

(I am reading your old posts) Hang in there ! At least you didnt have to wait 28 months like I did.

It was going to be no 99.9%, but judge said to submit written submissions so was kind of saved by the well and then sent final reply on March 28th. God was with me though.

We were refused in January of this year, thanks to an arrogant ahole of an immigration officer. After our interview (which he was totally unprofessional and rude during), we ordered the GCMS notes and it was as if they weren't even in the same interview! He totally lied and made things up, things which my then common-law partner (now husband) never would have said and weren't even true! We've appealed and hired a lawyer now. This has been really hard because we are apart again mostly due to financial reasons, and our lives are just totally disrupted and turned upside down because of his rotten decision. We're just so angry and upset with what's happened. We strongly feel that we've been totally discriminated against since we're a mixed couple, and it's so evident by the officer's notes. It just feels like an uphill battle and is so frustrating because genuine cases like ours are refused, while there are freaking marriage bureaus in Punjab which marry off villagers who can't even speak English to Canadians without a problem!! It's people like this who ruin it for everyone else! :'(
We only hope that one day (soon) we will be together here in Canada, so we have to be positive, look forward, and leave this anger for the officer/injustice behind us.

Anyhow, my question is, what is the ADR and full hearing waiting times for Vancouver? I am in Calgary now and was advised by my lawyer that it takes 10 or so months for an ADR and 18-24 months for a full hearing, but in Vancouver it can be a lot faster... I will most likely move to Vancouver if this is actually the case.

Hi harry, very sorry to hear that, i feel ur pain because ive just went throught it. I live in Edmonton, and Ive waited 18months exact for full hearing, so i would think Calgary would be the same. I hope u get the ADR, which would be about 6-8 months quicker, but thats only if ur case is not too complicated. I hired a lawyer to help me. A tip for u would be keep pushing and calling or emailing ur lawyer after about 12months of waiting. because he wil be the one to set up the hearing date whenever the appeal division people are in town. they are from vancouver so they come down to calgary or edmonton only once in a while. so if the appeal division people come in town and ur lawyer is on vacation or whatever, then u have got to wait some more. so yeah keep pushing ur lawyer, u pay big bucks for it, u have the right to push him. in the meantime try to save some money and visit your spouse, this will get more evidence and proof. and practice questions with your spouse so u guys will be ready when the court date comes. good luck.
