first thing you need to do is file your Appeal. You have 30 days. It then becomes a waiting game. I can tell you that I had to wait 2 years to get a Hearing date in Toronto. If you get an ADR, it will be around 6 months. Keep in mind, timelines change. Hopefully, it will be shorter time for you. (I am in Toronto while my partner is in Mexico)

I can tell you that most Appeals are allowed. Waiting, is the hardest part !

Hi gsize
u remember me ryt?
wat do u mean by ADR? & how come make it to a shorter time?
& anyone knows whether if we appeal in Vancouver it'll get little time more than Toronto?

Hi there

I received my refusal letter yesterday and I am absolutely devastated. Just as everyone has written in here, what is stated in the letter just makes no sense whatsoever, I applied in the conjugal catergory but was told today by an immigration specialist that catergory is almost IMPOSSIBLE to be admitted in!!!! Wow! Who knew!! The reasons they stated are just stupid.......so unbelievably stupid and I wonder why or even how they are allowed to make such sweeping judgements about a persons relationship!!! So depressed right now, it looks as though the appeal process is a complete joke too and a long long time waiting. The only redeeming factor in this is that I am already in Canada with my partner BUT God only knows how I am expected to live or survive when I have absolutely NO INCOME because those fools.....do not allow me to work!!!!!

I am so so angry...............so very angry and sad.

I feel for everyone on here and I believe you when you say that these immigration officers are lying and making things up, I've worked hard all my life and only want to be able to WORK and EARN a living in Canada.........and they refuse to let me even do that!

We have sent our letter to a friend who is going to look over it and see if we have a case to appeal..............if not then :(

ADR is given when they feel your case can be resolved quickly (one or two issues) This is done to speed up the process. (at least thats the offical version) Im not sure if you do the appeal in Vancouver if you live in Toronto. Maybe someone know this question.

Its much faster in Vancouver (I had to wait 28 months for my hearing date in Toronto)

I also won my appeal in February, and I received my written decision last week. Does anyone know what happens next? My husband lives in Tunisia, but our application will be processed through Paris. I understand our decision will be sent to Ottawa first, then they will send it off to Paris, but other than this, I know nothing.
this is what happend to us after successful appeal in August 2012. The file arrived end of January in Ottawa, we then got word from Mexico (original visa post) beginning of April asking for updated forms. I feel the end is near.....I keep praying !

Hope it helps !

OMG. It took 5 months for the appeal office to send your file to Ottawa? Why so long? Did you get your decision the same day as your appeal, or did you have to wait? How long did it take for you to receive your written decision in the mail? Does it show 'in process' under ECAS under the same Client ID# as before? (sorry for bombarding you with questions) :-[ Looks like we're in for another long wait. :(

I dont know why they took so long. My MP told me, it takes time to write up the decision and send it off to Ottawa. (I however, have my own thinking on this) The judge told me at the Hearing that he was reversing the decision. I received written decision 2 weeks after that. I only recently started following E-cas. I have a new file number. It shows 'in process' You are not bombarding me---I am happy to help ! I am meeting with Imm consultant Friday to go over updated forms and hope to send to Mexico shortly after that. I can only hope that someone will have some compassion and finish it off asap ! April is 4 years since I started this nightmare ! Maybe yours will go faster ! 8)

I think I read on CIC website or somewhere, that sending the files to Ottawa first, was suppose to save time? yeah right! Did the Mexican visa office send you or your spouse the new forms to be completed or do we print them from the CIC website? Was your appeal heard in Toronto too? (it will be 4 years for me in October) Anyways, thanks for the info. - I really appreciate it. :)

In my case, they (Mex) contacted Immigration consultant who called me with the news and they forwarded me the updated forms Yes, my appeal was heard in Toronto (28 months wait)

Hi everyone ,
Can any one Help me in my case?
My spouse got a refusal letter that state that "The documents and some forms they asked to my spouse to send ,Islamabad Embassy did not received while my spouse had been sent documents to lawyer and Lawyer sent to Islamabad Embassy . and they also mentioned in letter that , Islamabad Embassy sent reminder on 3rd jan, 2013 to my Lawyer. my Lawyer says he did not received jan,3rd letter. I am giving some details below.
Applied on Feb 2011
Got approval march 2011
requested more doc on 18 April 2012( original marriage cert+photos+bankstament+emails+letters+gift receipt+...)
all papers sent on 22 june 2012.(as lawyer show in a file)
med request 15 may 2012
medical done 02 july 2012 (2nd medical )
refusal letter received April 10,2013
reason they state in letter ,they requested documents on 18 April ,that not received to Islamabad Embassy and they resent reminder letter on Jan 2013 ,we did not received reminder , while lawyer didn't get any reminder )
and April 10, 2013 they sent refusal letter .

I really don't know what to do ?
I contact to my lawyer , he said, he had mailed to embassy and embassy said not received ,and Lawyer also says the reminder letter of 3rd Jan 2013 also did not received to lawyer . I have filed appeal on 15 Apr 2013 .what is the chance of ADR or court hearing? what is the expected waiting time of Toronto , if either one I get ADR or court hearing? what could be the output of this case. And
Change of lawyer would be good decision or I should keep same ?
Plz if any one can help me ? I will appreciate your reply.
THANKS.

still you have a chance
why dint you call the embassy where you got the refusal letter? I also had the same problem with me.
but they have mentioned only two of the documents wat i have sent to them, and saying that i was failed to send them to the embassy. then i went to appeal on the next day i received the refusal letter. i told them i sent all the requested documents before the time they have given. then i was asked to send them back. i sent. now they say the documents i sent now are with the officer for review. so thats the worst part lawyers dont know. they just appear as a representative. they do nothing. you just call & see. dont tell that you sent the appeal form, in the first. see what they will say. may be it'll be ok may be it'll not work. but try & see. call your embassy outside Canada (which the applicant's application is processed)

Hi I am new to this website. My husband lives in India. I live in Vancouver. We got the refusal letter about 4 months ago. And after that I got the documents back from India. About two days ago I got a letter from court in Vancouver that it is going to early resolution officer then after they review it it will go to scheduling unit. It also said it might be near the end of the year until they process this appeal. Now I am wondering does early resolution officer mean it will be sent to ADR. And until end of this year is that timing for full hearing or ADR. Also how long more I have to wait until they let me know the exact date. Or in the mean while can I do something to speed up the process. Like send more documents. Any replay would be great. Thanks to all who read my post
