AND ALSO there is a small error also in my son's (Dependent child) CONFIRMATION OF PERMANENT RESIDENT FORM ... there are SPONSOR INFORMATION---- there is UCI DOB NAME RELATIONSHIP ADDRESS so, they have mentioned that "SPOUSE" as the Relationship ... So, my husband is the "STEP FATHER" to my son so, will it be a problem or is that the way they mention as I was sponsored under Spousal and my son is under my application?Huh?? Yeahhh ready to fly. Now your case is like regular visa holder. It's really good that you traveling with your husband. My cousin just brought her husband first time with PR visa. She said it was good that she went. Immigration gave hard time to people who fly without the sponsor. Also thats good you have all the copy of the documents. I believe the 5 year ban applies only to cases of misrepresentation. So, if you misrepresented (lied) in your case and the appeal is not successful then, as far as the government is concerned you misrepresented your case and you are banned for 5 years from that point.ajarupan said:My lawyer told me even if you cancel full hearing there is a new rule -5 year ban. Hi Wintersnow, our timeline is pretty similar, and my husband has received the booklet which has the info of our case, we are waiting for further notice, whether it will be a ADR or full hearing. You are correct ... I put in the appeal in early January. I received the blue book sbout 3 weeks ago. My consultant is now preparing the material for our appeal. Once she submits that she will ask for a date for our ADR. We are doing it by ourselves, thanks for your information, we should collect the info as well, and send them to offices, then we ask for a date. Hi Shuaibks, I believe Wintersnow appealed in Vancouver, so do I. He hired lawyer, and I didn't. Wiintersnow and I have the almost same tiemlines. Appealed in late Dec/early Jan, and received the booklet of case info in middle of March. Waiting for ADR/Hearing date. I think its convenient to have a lawyer----a good one, I didn't have one because my husband and I dont have the spare money on it. I didn't hire a lawyer ... just a consultant. She seems very capable. Consultants are much cheaper. I think you only need a lawyer if you are going to a judicial review. I think it is Gango who recommended going to the CanLII website to look over cases that have gone to judicial review. I looked over one case and I was quite surprised it had to go to court. It makes me very concerned about my own case and I feel much more comfortable having some help along the way. Someone who knows what to expect.
It is important to know what you are trying to accomplish in the ADR. My consultant seems to understand what we need to do to convince the Minister's lawyer that the VO was mistaken in his assessment that our relationship was not genuine.
However ... only time will tell if I have wasted more money on our case ...
