As regards, having an Alternate Dispute Resolution Hearing,(ADR), I telephoned the Case officer, at the Immigration Appeal Division, assigned to your case, and she advised me, that their procedure now, is that when they receive the Ministers Record, which you also received in November, 2013, a Board Member reviews the file, including the interview notes, and the refusal letter, and then decides if an
ADR is warranted, and the immigration officer may have made a mistake, in refusing the visa to Canada, and avoid a full appeal hearing. The Board Member decided that this case should go to a full hearing.
I explained to the case officer, that I have additional evidence to show the genuineness of the marriage, and that it was not done, only for immigration, and I would like to have the Board Member review my documents and evidence I received from you, and to reconsider his decision, not to hold an ADR.
The case officer agreed with me, and stated I could send in to The Board, and The Minister of Immigration, my written request, for an ADR, with my supporting documentation, and the Board member will then review the case again.
I will keep you advise

I have an advice for every one who is going through the appeal. I am no expert but I can share my experience. Just because you have a lawyer does not mean you can not talk to the case officer or can not know what is going on. I had a lawyer but I kind of did not trust him as previously I had bad experience with x lawyer. I took things in my own hands and I did not trust everything my lawyer told me. So I was in touch with my case officer and kept asking him and taking his advice on things I should be sending, questions that I had etc. You have full and complete right to know what is the procedure and weather your case will be selected for ADR/ full hearing. This process is supposed to be transparent and you should ask anything you want to ask to your case officer. He is assigned to help you.
I would also highly advise analyze your case as thoroughly as possible no one knows your case better than you. Place your self in officer's shoes and instead of just blaming the officer try to think "why he came to this conclusion?". He has no personal grudge with you but definitely there are things that are missing which led him thinking this case is not genuine. Try to find those things and bring them forward in your ADR/full hearing. Stay focus, positive and cover every possible aspect of your case INSHALLAH it will be okay.

It is sickening... The manner in which she spoke to my husband was extremely degrading.... He is a well educated man a General Manager for very large company n Dubai... Language degrees in both French/English at the University level... So having 3 languages (Arabic of course) he understood very well every nasty word that came out of her mouth ... My MP is involved and I'm not letting go of this... These officers are representing our country CANADA... They are a HUGE insult and act like they have no clue of our culture and Canadian customs. Something really needs to be done... What gives them on there own personal right to play judge, jury and executioner.... SHAME ON THEM, messing with people's lives like this, on a whim that they decide they dislike you... I am a firm believer in what goes around comes around... Karma is a b$& @ #%!!!!!

I am bit lost ... what are you trying to do? Have they asked you to do medical if so why they did not send you forms? if not why are you doing it by your self?

I did not receive full medical, mine was reassessment of medical which is different form full medical.

They will only ask for your reassessment of medical if your medical is about to expire or been expired for 15 months. More than 15 months they will most definitely ask for full medical.

Hey, hhassa, how would I find out who my case officer is? Would I find out from my lawyer?

@ hhasa the reasons outlined was the fact that i did over stayed, and then made a refugee claim, though i find ok you have something on me there are many others that ive seen on here herd of in similar circumstances, some was never denied in the first place many as well did get adr.
